Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

One of the problems that NHS Fife have that became apparent this morning is that everyone knew Sandie Peggie had committed heresy against gender identity ideology, that they needed to stamp on it hard, but underlying this was that they hadn't put their heads together to decided what the actual heresy had been.

The earlier 'what am I supposed to say? Yes. When asked if she knew whether she was male or female, seemed like another way of saying 'what a silly question, of course I know I'm female'

Sandie's mistake was to use vicious hurty words like 'man' instead of conveying her opinions in expressive dance or perhaps signalling them with rainbow flags.

Wouldn't have mattered if she'd done a gentle ballet interspersed with complete prostrations across a floor covered in feathers and marshmallows whilst whispering barely audibly "pretty please, oh great and wonderful Beth! I'm oh so very sorry, I hope you don't mind, please forgive me!" etc.

According to DrU himself no matter how she'd spoken to him, no matter in what manner the issue was raised, he would have taken it as a aggressive confrontation and hate crime 🙄

The captions on Michael Foran's Substack talk about this case yesterday were having so much fun/difficulty with Isla Bumba's name. One of the permutations was Alabama. Mind you, Cunningham was also causing problems for it.

People were also inadvertently (I'm sure) referring to her as Isla Bryson.

NC - email from JHurkiss to colleagues: ED was on board with my advice, impossible to keep them apart, advice was to suspend after discussion with GM. The real reason for the suspension was a need to protect DU from SP.
GM - I've said already it was about the risk assessment.
NC - what if SP raised again that DU was a man and shouldn't be in a woman only space.
GM - I wouldn't know, a convo between J Hurkiss and ED.
NC - before the break, you agreed, that patient safety allegations were raised because SP did not want DU in her CR.

Procedure so far:

No written policy.
No impact assessment
No risk assessment
No staff consultation process
Staff have lack of knowledge of H&S regulations
Staff have lack of knowledge of the Equality Act even if it's their jurisdiction
Male medical staff claiming they are biologically female
Female staff unable to absolutely say they are female.
Issues between HR, EDI and legal
Signs of clear activism and bias amongst DEI staff giving advice on the subject.
Signs of clear discrimination on the basis of gender critical views - no room to voice concerns - voicing concerns resulted in Sandie's disciplinary
Lack of note taking during the disciplinary process
Cleared of wrong doing in the disciplinary process after 18 months

At present I don't think Fife have provided ANYTHING to demonstrate they behaved in a clear, transparent or fair way towards Sandie Peggie. The most staff speak the worse this gets.

How many more days of this do we have to go?!

Same for me, I had no idea it was a name that originated outside of the UK. It's not disimilar to Bamba which has origins in Yorkshire I believe.

I think its closeness to 'bumbling' is what struck me as slightly comedic

No, it would not be public knowledge. Any offer to settle would have been confidential and without prejudice, meaning it cannot be brought into evidence. One of Fife's public statements seems to suggest they have offered a settlement that SP has rejected, but there is no way of knowing for sure at this stage.

Asked whether Davidson had completed a proper risk assessment before suspending a long-serving nurse, Malone admitted she didn’t know. Asked whether she had read the incident report—the Datix—that triggered the investigation, Malone shrugged: she’d been “off duty” over the holidays.

That incident, occurring on Christmas Eve, was the alleged confrontation between Sandy Peggie and Dr Beth Upton in a female changing room. It was the foundation for Peggie’s suspension. And yet Malone, the senior nurse with theoretical oversight of the process, appeared stunningly detached from the facts. She hadn’t reviewed the underlying risk assessments. She couldn’t say whether Davidson had sufficient experience. She couldn’t remember whether other incidents had even occurred.

The contradictions were glaring. Under questioning by Naomi Cunningham KC, Malone insisted that Peggie’s suspension was not based on a single interaction. But when pressed, she conceded that the entire episode circled around “the allegation”—singular—referring to the Christmas Eve changing room event. No corroborating evidence of patient harm. No pattern of misconduct. Just one incident, vague and unproven, inflated into a justification for disciplinary action.

More disturbing still were Malone’s views on what constitutes “discrimination.” Asked if it would be discriminatory for a nurse to question a male colleague’s use of the female changing room—even without aggression—Malone answered, unequivocally, “Yes.” It had been “addressed,” she said. The man—Dr Upton—had declared himself a woman. That, in Malone’s view, ended the discussion. Any woman who raised a concern was the problem.

Malone acknowledged that she had recommended “trans awareness training,” and admitted that NHS Fife had taken advice affirming that Upton was entitled to use the women’s facilities. Yet nowhere in her testimony did she address what rights Peggie might have had—or how her privacy, safety, or beliefs were factored into the decision.

Under cross-examination, Malone appeared not just evasive but deeply unprepared. She relied on vague claims of “risk” without ever pointing to documented assessments. She misremembered timelines, conflated incident types, and ultimately revealed a culture where managerial decisions were made by assumption, not evidence.

What emerged was not just a lack of rigour but a disregard for fairness. NHS Fife appeared to operate a one-way system: gender identity claims were accepted at face value, without scrutiny, while any objections—no matter how respectfully stated—were treated as disciplinary offenses.

Gillian Malone didn’t just fail to lead. She failed to explain, failed to remember, and failed to justify an institutional response that left a woman suspended, unsupported, and accused - without clear cause.

This wasn’t due diligence. It was bureaucratic abdication, wrapped in DEI language and executed by managers too uncertain to question policy - or even read their own reports. The tribunal continues. But after this testimony, the rot inside NHS Fife’s leadership is no longer in doubt.

It must be a nightmare at breaktime in the court house. Everyone will be dithering in the corridor, not knowing which toilets to use.

I bet some of the ( alleged) women involved will have been overjoyed if they woke up to their period this morning. “ Hallelujah! At least I know what sex I am for the next four or five days.” ditto those lucky enough to to be pregnant , or to have recently had a diagnosis of prostate cancer. Those lucky ones can walk tall, knowing that no one is going to have to check their chromosomes for fear of misgendering and being hounded on Reddit.
