NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #5

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

Thank you for this. I've complained to the BBC about that article being heavily loaded with Beth Upton's complaints and marginalising Sandie Peggie, not making clear that Peggie didn't mention Isla Bryson's name or talk about rapists, not making clear that Peggie felt intimidated and embarrassed by a male-bodied person's presence in the changing rooms as she was dealing with a heavy period, and the article including a picture of Peggie but not one of Upton.
Also that, while there are two further articles on the case with more detail on Peggie's 'side' of things in a 'more on this story' section below the main one, this seems to be a deliberate choice and readers aren't necessarily going to read those as well as the one that was chosen as the main, large story.

I complained on the basis of inaccuracy, as the detail of Peggie having a heavy period is freely available in the transcripts, as is her statement that she did not mention the name Isla Bryson, or the details of his crime.

Of course I expect the usual waffle back, but I feel it's important to keep complaining.

When complaining to the BBC, I'm always a big fan of referring to the Royal Charter which is the constitutional basis for the BBC:

So am I getting this right?

Just a couple of years ago Dr Upton was happily playing rugby on a men's team. Voluntarily showering with other men, sharing changing rooms with other men, enjoying all the bawdy humour that goes with being in a men's rugby team. All while holding down a demanding job.

But then Dr Upton transitioned. And then discovering that a woman didn't want to get undressed in front of him made Upton very upset. And when that woman did it a second time it made Upton feel so fragile that Upton needed two months off sick.

Tell me again how transitioning really improves people's mental health.

Can anyone give or point me to a TLDR version of what's happened in court?

I can't keep up during the day and the threads are mostly commentary which is very hard to follow... I'm also finding the live tweets very hard to follow this time for some reason.

Sorry but I have a migraine and can't do it all today but want to know!

This feels so set up, keeping notes from Day 1, I wonder if DU has notes on all of their colleagues? SP said she and another nurse waited outside the CR on the second incident.

  • by whom ?
  • will that person contribute to process at all (or are they the ones who have moved to new job)?
