NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #29

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

It’s not really the name though. It is the person, and how the play on their name might be reflective of their talents or lack thereof. Remember Jeremy Hunt. By calling him an expletive, nobody was saying that all Hunts, eg ages ago racing driver James Hunt, were being cursed at. Just Jeremy. Rightly or wrongly.

If you think it is wrong to do it to people with foreign names, then it must be equally as wrong for people with common or local names.

Sandie's mistake was to use vicious hurty words like 'man' instead of conveying her opinions in expressive dance or perhaps signalling them with rainbow flags.

This is the key point that GM is trying to deflect from by ref to SP's confrontational tone.
GM is no longer mentioning the alleged likening of DrU to a trans rapist, which would have been confrontational if it had ever happened. Which it didn't.

I had assumed 'Bumba' was a lesser known Scottish name, I suppose because it doesn't seem that different to 'Alba' or 'Cumbrae' or 'Bute'.

It's clear that it was Sandie's tone that was the problem.

If she'd asked DU in a wheedling, girlie voice for what she'd needed, maybe he'd have graciously permitted it? As it was, it seems she was a bit too forthright for a woman and didn't show enough subservience.
