NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #18

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks. However, it is going to overrun and there will be an adjournment with the hearing resuming in July (current best estimate). The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

However, as a result of problems with the livestreaming, apparently caused by a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

To those who don't know me, I have filed a similar employment tribunal complaint against a large public sector employer in England's side, also represented by Naomi Cunningham. Second preliminary hearing will be in February. More info available on CrowdJustice.com, pls search for Faye Russell-Caldicott.

The last weekend before the prel hearing is now approaching, all support would be hugely appreciated.

Another request to make to people reading the thread. We've seen what a nightmare this has been for Sandie, and what a gruelling and uncertain experience it is to go through an Employment Tribunal. It would be even harder going through it and worrying about how to fund it.

Other women are going through similar experiences and need our support, so at least they're able to focus on the important parts and not worry all the time about funding. One woman going through this is Sarah Holman who is crowdfunding under Harassed and Victimised for supporting Women’s Rights. It's possible she's unaware of the support offered by Mumsnet and it would be great if she could receive some.

Yes I believe so.

I can understand why she would want anonymity, although I'd deeply love for her to know how much we would all be cheering her on. With or without anonymity.

In her page though she does say if anonymity isn't granted the funds will be passed to another women's rights service. I've paid and I'm happy for this to happen. I wouldn't want to be in her shoes.

But if she does choose to proceed anyway then we are all rooting for you Faye.

NC Need to correct that diff for SP as had a dog and accommodating re working w/ends. CM email of 2 Apr and SP working w/ends - that must be a mistake re day weekends?

From the previous thread, if looking at numbers, another lurker here who has tried to follow/read what has been going on but hasn’t contributed as my legal knowledge on these processes is non-existent and didn’t want to derail or get something wrong.

I am aghast at what is happening so thank you for the wonderful coverage that the mainstream media seem to be avoiding.

NC Look at IX notes of interviewing AG: by 26 Apr you knew v well that SP being IX for alleged HI re the CR.

ED I thought also compared to a convicted rapist

Different levels of anonymity. They could anonymise her name 'Claimant F' for example. Or they could hold the entire thing in private. But it would be extraordinary for a privacy order to be granted for the claimant. If just her name, we could cover. If heard in private - no.
