NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #25

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It is planned that it will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access. However, as a result of problems with the livestreaming, apparently caused by a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

Above is from the BBC article today. I can't work out what it means by comments written by another observer.

I seem to remember that there was an hour or two when the Tribunal room tech was so appallingly bad that TT couldn’t get access, but some responsible people provided some coverage.

I might be confusing this with the FWS case.

It is a bit of whataboutery from the health board who have been ignoring, and still continue to ignore, HSE legislation about single sex changing facilities.

As I read that, a journalist would count as "not ... a witness or participant, but another observer".

There's some considerable reaching going on that members of the public watching court proceedings and discussing them is somehow illegitimate.

Is the BBC actually not capable of covering challenges against gender ideology in a way that informs the public?

Did a previous thread mention that some interruptions seemed deliberate for this purpose?

Yes, it appeared that some people were using the live stream to try to disrupt proceedings by turning their microphones on and making a lot of noise. However, without the actual judgement, we don't know if the judge was referring to that, or some alleged unfairness or inaccuracy in TT's coverage, or something else. The way the BBC article is worded suggests that comment may have been aimed at TT, but we don't know.

I like the way the BBC added:

The incidents alleged by Dr Upton happened before the UK supreme court unanimously ruled that a woman is defined by biological sex under equalities law.

Which is of course true BUT the law was still the same then as it is now and ignorance of the law is not a defence in a court of law 😁

Public Requests for open justice and TT access = about 600

I don’t suppose it took much thinking about. Must be pretty unusual for the tribunal to have 600 interested parties writing about anything at all 🤣
