NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #24

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It is planned that it will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

However, as a result of problems with the livestreaming, apparently caused by a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

If there was ever a gathering/fundraiser in honour of Tribunal Tweets, I would be there in a flash. Gender stuff aside, what you do is so important for getting transparent justice. I have learned so much from their work about how the justice system works (or doesn't work).

In the absence of easy to access live feeds, transcriptions or recordings, their work is vital. I think they should be funded from the public purse for all cases with a public interest.

I don't think it's a drop off on the second day, I think it's a count of unique users. So 12556 unique users logged on the first day. On day 2, 6688 new unique users logged in with Up to 12556 users from day 1 joining them.

My understanding was that someone had written to complain, someone not officially connected with the case. As others have mentioned, it's been very embarrassing for the hospital and they'd be delighted if it was possible to exclude the wider public.

I read the Guardian article on this and it was abysmal, as biased as you'd expect. Even the Telegraph, whilst sympathetic and more detailed, misses many of the nuances that you lot have picked up on.

My dentist has a TV in the waiting room with noise off and subtitles on. There are often some absolute howlers in the subtitles but I’ve not seen calls for them to stop (18m in the UK have some sort of hearing impairment).

I appreciate that NHS Fife have a rather blinkered approach to Equality, but they shouldn’t be allowed to censor justice.

This is one of the reasons that I would chip into a crowdfund for equipment and the cost of a webinar licence. Easier access, open justice, and something like the quality of the Post Office Inquiry.

I think more important, though, is the fact that these are public servants trying to hide their actions, and I did say that.

Having heard on the grapevine that only one request had been received to keep the tribunal open to the public & press, I also emailed to ask that it remain open and transparent.

The old 'oh, nobody has raised this issue' schtick is so common now when it's patently untrue. So I'm glad some of us have documented here that we've written.

Ive also just written to the Court to express my concern about Fife's application and request open access be maintained. Also suggested they adopt same system as UKSC which works well.

I hope their inbox is full of similar messages when they arrive on Monday morning ...

When NHSF are told to do one by the judge would that be something that would automatically apply to future cases and in the long run give TT more "legitimacy". I'm thinking in terms of the concerns about being debanked, etc. if you have a judge stating that you have every right to do what you do?

It's unbelievably desperate on their part.

In the highly likely event that they get told to fuck off, all it's done is draw massive attention, Streisand like, to the entire tribunal.

To be prepared to risk that kind of scrutiny, you've got to have something quite staggering to hide
