NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #20

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It is planned that it will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

However, as a result of problems with the livestreaming, apparently caused by a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

Wait what? WTAF are NHS Fife thinking? I really think the whole board needs to be dismissed following this omnishambles. It appears that patient safety and adhering to the law are trifles
that they do not concern themselves with. Really astonishing.

Hear me out, is this a cunning move by NHS Fife to encourage a standing Terven Encampment in Fife until this is all over, bringing much needed tourist money into the local economy? We'd all be eating our bodyweight in Tunnocks and other delicacies.

After all, those legal bills and coverage for special leave for witnesses to attend the ET won't pay for themselves and NHS Fife is in enough debt as it is.

Well this ongoing tribunal was going to disappear off the main news cycle for a few months until July but now this will keep it in everyone's minds again. It's just batshit and totally crap for Sandie but I hope it makes more people realise how awful this situation is and how awful gender ideology and self ID is overall.

NHS Fife seemingly on a scorched earth pathway through a shit storm of the very worst PR possible, of their own making, somehow thinking 'hold my beer' is the next phase. 🤦🏻‍♀️

There are standing appointments that you have to have on the board, IYSWIM.

The 'additional' hires, the ones not there by virtue of their senior positions, will be the NEDs who are supposed to be independent and offer useful challenges to the Chair and 'standing' board members.

This is a knee-jerk reaction to the proposal to add KS as R3 and to protect those above her. Immense pressure will be put on Sandie to withdraw her case. I hope, pray, that this latest foolish action by NHS Fife will blow up, spectacularly, in their faces.

An internal report is said to have called for Ms Peggie to face a further allegation of “misgendering”, in addition to the changing room incident, because during the probe she is said to have referred to Dr Upton as a man to investigators.

Reading this, it wasn't even misgendering to his face (not that I care about that at all) it was to investigators! Second hand offence on their behalf somewhat.

Bearing in mind the Court gave permission for DU to be correctly sexed (plus his own barrister called him 'he' a number of times) this is an utterly bonkers move.

I'm just totally 🤯 by this move. Who fucking authorised it?!

I really feel for Sandie - underneath the justifiable anger, there must be a huge amount of sadness at how her employer of 30 years is treating her.
