Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It is planned that it will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

However, as a result of problems with the livestreaming, apparently caused by a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

I agree - not fair to publish things about his family, they have enough problems as it is. And yes I know they've gone after Sandie's husband - but they go low, we go high.

I see that Swiney says that the law is crystal clear on single sex spaces, but that employers can choose to ignore it, if they wish. That's quite the oxymoron, isn't it?

By his standards, I (an occasional employer) can choose to ignore the Offences Against the Person Act and slap his fat jowls. Or the Road Traffic Act and run him over on the pavement.

He'd have no grounds to object, would he,

(Note to MNHQ - I am not being serious and would not do that, nor incite another to do so, I am merely pointing out the irony of him disregarding one law, but, doubtless, expecting everyone to abide by the law in general).

The disciplinary proceedings, first reported by The Telegraph, which are separate to the employment tribunal, was due to begin on Friday but has since been rescheduled at Peggie’s request.

At Peggie's request? You mean her solicitor said "are you really sure about this?" and NHS Fife rethought their utterly stupid uniquely innovative idea of holding a disciplinary in the middle of an employment tribunal.

The behaviour has been so bananas that it should be renamed NHS Fyffes.

Health and Safety perhaps?

The law is clear that single sex space must be provided - but there are different ways employers can do that - so a small employer can have one changing room but it's male or female at different times.

Many of the other newspapers put this as one of their headlines for the past week and before and published about it daily.

Another thought is about Scottish elections; if the ET concludes in July and the decision could take weeks or months, could it influence Nicola Sturgeon's re-election for example?

Also posting here the petition in support of Sandie which was started yesterday (I checked whether it was mentioned on this thread, if it was, I may have overlooked it)

To be fair, the search facility on the BBC website has always been crap in my experience. It regularly fails to come up with items that are definitely there, particularly news items.

There is a work around through google.
In the search bar, add the website address and a colon, and then search terms, like this
"bbc.co.uk: fife NHS"
then the results show up.

I just don't understand why we have to keep going to tribunals etc - at what point do HR and lawyers say 'Ok that mess with gender identity trumping sec was a total shit show let's get back to the actual law'

Actually I know they just won't. In my organisation our EDI team in HR have told me they expect the law to catch up with their interpretation of it so they are ok with what they say

Mr Menno is a lovely Dutch gay guy who's been in this fight for a long time and has made lots of videos about it. The barrister is Sarah Phillamore, a GC lawyer who has also been involved in this for a good few years, especially on the free speech angle. Both top people!😁
