NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #17

nauticant · 13/02/2025 15:59

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks. However, it is going to overrun and there will be an adjournment with the hearing resuming in July (current best estimate). The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

However, as a result of problems with the livestreaming, apparently caused by a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

The hearing is being live tweeted by https://x.com/tribunaltweets and there's additional information here: https://tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr. This also has threadreaderapp archives of live-tweeting of the sessions of the hearing for those who can't follow on Twitter, for example: archive.is/xkSxy.

NC Letter 3 Feb confirming SX and IX still ongoing?

Yes

NC So SP told IX ongoing

AS wrote letter. Still waiting SP was fir for the IX

NC Did u talk to anyone else

No, IX hadnt started yet

NC Shld have said IX is stalled

ED Or waiting to commence

That's rather damning. SP told investigation ongoing then admits not started.

And we know that at some point they will start all over again with a new investigation.

Poor Sandie.

The piobaireachd or ceol mór [sorry can only do the Irish language accents!] is spinetingling. Equivalent of our sean-nós singing, I think. Deep deep music from our souls..

I remember feeling like that the first time I heard the didgeridoo. It felt like it was calling to some deep elemental part of me, I felt it rather than heard it. Amazing.

Brainworm · 14/02/2025 11:55

RA can mean risk assessment. Not sure if that is what is being referred to here

ickky · 14/02/2025 11:55

NC Headings here re assess criteria [reads out re roles and continuation] Y're going to do check list before SX or restricting duties. So expect one for before she returns?

J Dont we see that here?

NC We dont see one for 1 Jan and 2/3 Feb

ED I dont see one

The petition to "fully" repeal the GRA has hit 4000 signatures. That's 1000 more than when I came across it last night. Someone was worried it wouldn't hit the target... I think there's no need to worry.

Someone posted above about it being easier to amend legislation than to repeal. The problems of de-transitioning and all the rest of the issues brought up in SP's case have exposed a lot of loopholes. Some legislation is needed and it is probably best to amend this Act - but as with all good negotiations it is handy to "anchor" the other side with a big demand and then adjust downwards later. If a lot of people support repeal then the lawmakers will have to admit there is a problem that needs sorting.

NotMaroonButRaspberry · 14/02/2025 11:57

I've peaked everyone I've spoken to in the last couple of weeks or they were already there. Bar one person who broadly agreed with me but corrected my misgendering....

ickky · 14/02/2025 11:58

NC Is there a doc for Jan

ED I havent completed one

NC [find new doc] These are SF's notes on SX review mtg on 7 March. Have you seen before?

ED [reading them] I was present but dont think so

NC Fair account of the meeting?

ED [pauses] Covers most of discussion, yes

Chariothorses · 14/02/2025 11:58

Good to hear @Justasmallgless . It's amazing how many women across the country are discussing this case with fury, not just in Scotland

ED Lottie wrote it

'Do it to [insert name here]'

Melanie said it, Ask Kate

This is all It wasn't me Guv, do it to them isn't it?

Desperately trying to save her own skin and looking totally incompetent into the bargain.

Sorry it is half term here. That's why some of us can participate.

ickky · 14/02/2025 11:59

NC Covers CR but not the 2 missing incidents

ED It was about her return to work and protecting and supporting her

NC [new doc: email of 12 March of CM re revoking SX and opposite shift patterns] This given as reason for lifting SX

Yes

NC Can see whole reason for SX was contac

SlackJawedDisbeliefXY · 14/02/2025 11:59

There seems to be a distinct lack of WhatsApp use at Fife - is this likely?

IDareSay · 14/02/2025 11:59

NC [reads re SX record we received last Friday.. reads re SX letter] It doesnt mention patient safety records?

NC U were asked yday in evidence in chief and u chose B&H as reason to suspend

This is showing how foolish it is to rotate your globe around an axis as contested and irrational - nebulous, you could sayWink - as the concept of transgenderism. The centre cannot hold and things, and witnesses, fall apart.

This is another reason (of the many) why I love this thread - posters paraphrasing Yeats and referencing the films of Almodóvar (see: women in comas). Everyone is so clued up.

Whereas DU hadn’t even read 1984. Or said he hadn’t.

It's insanely hard to have WhatsApp released - well known tactic to get around things where Ive worked previously.
