NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #17

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks. However, it is going to overrun and there will be an adjournment with the hearing resuming in July (current best estimate). The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

However, as a result of problems with the livestreaming, apparently caused by a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

Another request to make to people reading the thread. We've seen what a nightmare this has been for Sandie, and what a gruelling and uncertain experience it is to go through an Employment Tribunal. It would be even harder going through it and worrying about how to fund it.

Other women are going through similar experiences and need our support, so at least they're able to focus on the important parts and not worry all the time about funding. One woman going through this is Sarah Holman who is crowdfunding under Harassed and Victimised for supporting Women’s Rights. It's possible she's unaware of the support offered by Mumsnet and it would be great if she could receive some.

Thanks for the new thread. Just caught up. Can I ask for clarity about one of the emails recently referred to, where KS is saying 'Dr U knows that we condemn SP's actions'?

a) Is that as bad as it sounds (it sounds to me like they have pre-judged the investigation AND communicated that fact to one of those involved)

b) Was that part of one of the sets of emails disclosed since the tribunal started, or had it been disclosed in advance, in line with the order?

It sounds to me that they've given DU complete control.

He should just have been told that HR are dealing with it. Nothing more , nothing less.

I can't see how KS won't know the details of the tribunal by then. It's not reasonable to expect her to not use social media / read any media and it could reasonably be in professional journals, too. I think that if she hasn't identified as a member of a non-speaking religious order by then, she'll just say she can't remember as it was too long ago...

Feeling quite bad for ED, she was put in an impossible situation and is struggling to rationalise it even now.

Bollocks. She's cowardly. She should be acting in the interests of patients and staff. Not pushing ideology. No sympathy at all. Its her job to deal with this.

Yet the woman doesn't understand how to manage conflict, doesn't see to understand large parts of the law and doesn't understand sex and dna.

She's clearly been over promoted above the level of her ability for some time to be THIS MUCH out of her depth.
