NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #22

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It is planned that it will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

However, as a result of problems with the livestreaming, apparently caused by a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

I note the judgement quoted in the article refers to Rose as 'her'. Do we know if there is/has been any application or ruling on the use of pronouns during the hearing as in Sandie Peggie's case? I think it makes such a difference.

I caught the tail end of Rethink on Radio 4 this afternoon taking about the boggy ground where liberalism currently finds itself.

There seemed to be some interesting comments with regards the rise of identity politics in that last 10 or 15 years

Oh yes. When these men are controlling the show they are hardly the retiring wall flowers. He would have to be a right attention seeking, brazen, show off, to be swanning around in female changing rooms in his boxers. I'm so pleased the judges in both these tribunals have refused anonymity. Let the world see just what these nurses have been up against.

I'm glad the judge found that 'Rose' had no evidence whatsoever to support his application for anonymity. He made a vague reference in his witness statement to 'horrible comments'. Let's not forget that this, with the help of no doubt very expensive and specialist lawyers, was his best case.

Yet the nurses presented evidence at the hearing that the fragrant Rose has been campaigning for Stonewall on Facebook and is a member of a 'Transgender shit-posting ' group.

Such a delicate flower.
