nauticant · 10/02/2025 12:57

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

We are beginning to see here just how important it has been for the judge to tell NC she could call him a man in court.

Indeed.

themostspecialelfintheworkshop · 10/02/2025 13:19

Whilst i'm annoyed the judge wouldn't allow the 1984 comparison - because it's exactly analogous except fictional so no-one really harmed- I bet DU's really frustrated he doesn't get to endlessly pontificate about why Winston's a bigot and possibly why the whole of 1984 is bigoted.

Men claiming that they are women are engaging in a work of fiction. And the judge is allowing that. Even blokes claiming that they are ‘biological females’.

Peregrina · 10/02/2025 13:26

How does he know if someone coming to A&E needs a pregnancy test?

This sort of nonsense is why men get asked if they might be pregnant. Which not surprisingly makes the male patient annoyed or the HCP look stupid.
I think it's mainly to cover transmen, who are of course, women.

It really is time this gender nonsense was knocked on the head.

Love you all to bits, deeply respect your informed and intelligent commentary but I'm going to ignore you till the tribunal actually restarts, to actually eat something today!
Having to tear myself away from the screen..😟

Thanks for your sterling work @nauticant , much appreciated.

All births are recorded by a medical professional if they were present.

Sex is observed it is not assigned.

Edited

Don't think so, at least not in Scotland. There doesn't have to be any medical professional involved, does there? (ETA: now I see an edit "if they were present", ok)

Madcats · 10/02/2025 13:28

So are we at the stage where a woman is anybody who says they are a woman* as well as the women who think they are men?

There isn't going to much space in the female CR if Pete the Plumber needs to do some plumbing too!

  • no need for surgery, presenting as a woman, dressing as a woman (whatever that might be), just an internal identity that an observer might not spot immediately (and might come and go).
Chariothorses · 10/02/2025 13:28

I found this witness's lies distressing but not at all surprising. As
@OvaHere says 'He enjoys the power of making others, mostly women, capitulate to the lie.'
The government were warned years ago about the devastating impact TRA/ Stonewall lies are having on women/ children. In the tribunal today the judge didn't once remind Upton he's under oath.

Cailleach1 · 10/02/2025 13:29

Yep, Anyone who merely says they are not a man. Anyone falsely claiming they are a woman (or biological female). Where will the real women go, so as not to be the ‘miscellaneous’ sex?

GrumpyMenopausalWombWielder · 10/02/2025 13:29

I can't keep up! Place mark.

EasternStandard · 10/02/2025 13:30

Does whoever gave permission for the CR to be used get questioned at any point?

Or NHS Fife decision makers as a whole for creating this scenario

bumbledenbarsk · 10/02/2025 13:30

I'd like to ask him how and when he realised he was a woman.

myplace · 10/02/2025 13:30

I’m in @BountiesAreUnderrated !

Not sure why. Chrome wouldn’t let me but safari did.

So anyone still trying, observer and the code and ping it happens. If it doesn’t happen, try again a few times.

Sorry, I meant to put recorded have edited.

Upton knows damn well who is female and who is male and the biological difference between them otherwise as a doctor Upton risks misdiagnosis and killing patients.

Just one very basic example that Upton would have seen many many times.

Quite. I would love to have NC ask which markers should be used if he needed any medical treatment where measurement of anything had sex specific ranges.

Thanks, fanOfBen, and everyone else who has replied. I can see a record being kept of a hospital birth, or a midwife attended home birth, but had no idea what documentation (if any) would be needed to register the birth.

CriticalCondition · 10/02/2025 13:31

He's probably spent the weekend reading lots of affirming 'you go gurrlll!' stuff. Plus the glow up and the soapbox opportunity no wonder he feels great. He thinks he can outwit NC. His barrister does not share his confidence. That's why she keeps interrupting.

NC has only just got started...

IPreveil · 10/02/2025 13:31

It seems to me if someone had actually bothered to manage DU a bit at the early stage of his career we might have a competent dr and less of this waste of public funds.

Can I have the Pat link please? I know someone who’d love it.

I think that is Esther Davidson (but haven't gone back to check).

Hopefully NC will ask about why she thought she had authority to do so.

Sarahbackinthesaddle · 10/02/2025 13:33

Not been able to
Log in this morning. Anyone able to summarise events for me please?

Peregrina · 10/02/2025 13:33

I would love to have NC ask which markers should be used if he needed any medical treatment where measurement of anything had sex specific ranges.

He's already tried the "I'm not an obstetrician" line, so it would need to be a question about something he could expect to encounter in A & E, or whatever rotations he has done.

FriedGold32 · 10/02/2025 13:33

I'd pay a monthly subscription for easy access to all of NC's gender cases on TV. Perhaps something for her to consider, her own streaming service.

mb2512cat · 10/02/2025 13:34

Glad to be watching this live. I don’t doubt the sincerity of DU’s statements, so the only conclusion can be is that he’s completely deluded. I have to keep reminding myself that he is a MEDICAL DOCTOR. Argh!!! I do fear that the medical schools are teaching this BS to their students now though.

ThatsNotMyTeen · 10/02/2025 13:35

He was “instructed” to use the female CR. Sure.

To paraphrase my mum, if someone “instructed” him to jump in the Clyde would he do that?
