NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #30

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I think in one respect EP acted quite reasonably in allowing DrU to offload after the incident, giving platitudes and then sensibly getting DrU off the premises and home. Sending a quick update before driving home.

Her mistake was not then considering SP or her version of events.

WRT the policy of allowing DrU to use the women’s changing room. Whether or not there is a written policy NC/CE have established that there was a consistent understanding by staff that DrU was allowed in the women’s changing room. Fife are responsible for this - probably IB or HR.

I'm confused because I imagine that Vic Valentine would be a useful witness if you wanted to show that the hospital had not discriminated against somebody on the ground of gender reassignment. It's less clear whether Vic Valentine is a helpful witness if you are trying to establish that you didn't discriminate against somebody because they are either a woman or have GC beliefs.

I'm not sure Fife understand the question either though....

Oh and I also am SOOOO not surprised that they tried to surpress the note.

They are totally incompetent.

It's pretty possible, in places like Edinburgh and St Andrews and especially when connected with the universities, to live in the kind of bubble where you are never really exposed to many actual Scots, and never acquire the cultural competencies required to understand social/linguistic differences in any meaningful way, or integrate in a way that values and respects the place you live in and its people. So yes, Upton (jr) is very likely to have been a bit freaked out by someone like Sandie Peggie.

I'm not sure it would have been appropriate for EP to talk to SP, TBH. It's not her job to get Sandie's side of things, she can't tell Sandie Upton was wrong. She may well have sat in her car and felt for Sandie, I don't think there was a way for her to communicate it. My gut feeling is that she thought this was a storm in a teacup and Upton would sleep it off and it wouldn't go any further. She sent out that quick email to start a paper trail and cover her own arse just in case.

Is Jeremy Upton the father or grandfather?

His LinkedIn profile indicates he attended Madras College which is a secondary school (isn't it?) so he must have moved to Scotland as a youngster.

But yes, Edinburgh is about as close to being in England as you can get in Scotland, which s probably why the English love it so much.

Interestingly (I'm not Scottish) my (Scottish) kid visited St Andrews recently with me and I raised the issue of choosing Unis - his view was St Andrews (both town and gown) wasn't really Scottish to him and he'd rather go somewhere else.
