NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #30

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

This morning's testimony is why the trans activists are raging so much about the Supreme Court judgment. The ability for #bekind people to be manipulated and so manipulate in turn has been severely curtailed. They can wail about poor Beth or whoever, but a grown-up can say "it doesn't matter, it's the law".

That's the "rights" that have been lost.

I think this is a very good point. I’ve read a lot of personal accounts written by women doctors. They all stress how they had to work easily twice, three times as hard as the men, and show absolutely no weakness whatsoever. They often have to battle against (male) seniors who treat them with contempt. The idea of them 'sobbing' because of a few hurty words is incomprehensible. Let alone the notion of them having to be escorted to their car in case ‘something happened'.

But focus on the humiliation of having the entire group of your seniors told how you were upset, and by a nurse, too!

And a general point in relation to tone - I suffer at my own workplace from an insistence that ghastly, insincere, condescending politeness is an appropriate way to communicate and any kind of straight talking is the kind of dreadful unpleasantness that must be immediately stamped out. I find it alienating and upsetting to the point of creating a hostile working environment. But there's no account taken of that or of those who feel similarly to me.

Love this point. I take a genuinely friendly, supportive tone at work myself in general (although I hope not overly saccharine) but I absolutely appreciate not everyone is naturally like that. As long as someone isn't shouting, swearing or name calling then their natural demeanor and approach should be perfectly acceptable. We don't all need to be friends at work, we don't all need to be full of the joys of spring, we do all need to be polite and respectful. It really isn't rocket science but again the expectations are sky high because nothing other than fawning over what an amazing woman you are is enough to convince that you're not the enemy.

Just had a conversation with DW during the break in proceedings. She tells me that when she experienced menstrual flooding at work (hospital), she felt physically faint and very distressed, and was sent (or taken?) home. And yet no-one seems to have considered SP's side of the confrontation, or her feelings. It's all "poor Beth" and stroking him.

Dear god, if there were ever a lesson for women to stick up for themselves and their peers, then this is it. All the consultant doctors are out in force against the nurses and the nurses really need to wake up and be furious.

She is absolutely being set up to take the fall. To be fair, she has not helped herself probably due to lack of management experience but yeah, she’s the fall guy.

It gave them a warm fuzzy feeling because it aligned with their political identity as being 'accepting' and 'tolerant'.
