NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #30

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

They've switched off the mike now, but until then the level of inane chitchat we were overhearing was something else - if I were depending on Jane Russell to get me out of a tight spot I'd hope that her mind was on something other than makeup shopping just ahead of the beginning of an evidence session.

To be fair I expect you need to be good at inane chat whilst waiting as you can’t discuss the case, you don’t want to get into a discussion you need to think about and you need to be ready to go when the judge appears.

I had my first ever deep fried mars bar in Malmö during Eurovision. They had lots of street food stalls at the official fan village which were themed along the lines of national cuisine.

Trying to explain why the Irish themed bar serving Deep Fried Mars Bars as Irish food was 'slightly controversial' and probably should have been questioned by the Swedish organisers to my Dutch friend was amusing.

It was nice though.

Prompted by something I read on X, I have a question - is it usual practice for nurses and doctors to share changing rooms? Don't they have different areas?

It might be usual practice, I'm just wondering.

Should he have used another changing room being a doctor (not just being a man)?

In the NHS depts I've worked in, more senior doctors have changed elsewhere but typically because they have access to offices or rest rooms that nurses don't. Not because the changing rooms were segregated by profession. I have mostly changed with other (female) nurses but our shift times all align whereas the medical staff arrive and leave on a different set of times.

There would be no issue with a female member of staff of any colour scrubs being in the female changing room.

The trouble at the heart of this is an unwillingness to grasp Sandie's particular discomfort that Christmas Eve. Anyone who has experienced menstrual flooding in a public space will be there with her in that changing room. Bad enough if you are not working in a busy environment. Other reasons may have come into it but that should be sufficient - a basic right to wash, change clothes, replace sanitary products in a clean safe environment.

It's such a good lesson into how effective forcing people to use preferred pronouns and names can be. Like yesterday when GM used "Beth" all the time.

It really helps obfuscate the issues, even written down.

AHH well at we can now be full confident JR is a woman. Talking about makeup and shopping definitely female. At least that one more person who is certain of their sex. Phew.
