NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #9

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

EXACTLY. I thought the same thing. His argument is so full of contradictions. I'm not sure NC is picking up on all of them.

BU - yes, but I disagree that's self evident. There is some portion of people who believe those things. Doesn't make them true. Doesn't give people the right to be prejudicsed or rude or disrespectufl

So why is what he believes is what goes?

What is his definition of gender identity that is so rock solid and well evidenced that its more clearly defined that biological sex?

How is that not just all ' shite I have made up as it suits me'.

NC - proportionate solution to balancing rights and needs would have been the one that doesnt' interfere with their privacy or yours

JR - there are three trans peopel at the hsopital. Only person who complained was the complainant.

I suspect they can see it honestly, but few will speak out

I'm struggling to listen to this, he's making my skin crawl. I feel so sorry for Sandie having ever had to be in contact with him.

I do hope Wes Streeting has someone from his team following this. The solution is very simple rather than continuing to enable this and falling into a world of insanity where nothing means anything.

How can he not make a decision re the privacy of his identity and yet make decisions about his identity being female?

BU - not aware, but possible she's chosen not to tell me

May be other transwomen in the department, how would he know unless they told him

NC - so more proportionate solution would be for you to use single occupancy room

BU - no. At present number of colleagues in group who objects is one.

Can we please bring up Maya's judgement. Not respecting their belief - which letting him in their changing room does - is discrimination against sex realist beliefs.

Did JR just potentially out other trans people? That's a bit naughty isn't it? What about the privacy of their identity? It surely invites speculation, on the vanishingly small off chance that other people have t already spotted it....

It's actually quite chilling to see a man so sure of himself and spouting absolute lies so confidently.

Who are the people sitting behind him?

I thought witnesses could be present - they just can't discuss things with other witnesses while they are giving evidence - so DU won't have been able to speak with other respondent witnesses during lunch or be on any group chats.
