NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #9

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

NC - at least one of your colleauges experiences your presence as distressing, identifies you as a man who doesn't care about women's boundaries

BU - I'm not a man. Says nothing about my respoect for women's boundaries. One colleagues is uncomfortable. Most productive would have been a convesration to resolved.

I can’t remember the time/date of the incident when he roamed the hospital trying to find people to tell about his 'upset' - can anyone help? It wasn't a pre-arranged meeting with his supervisor where he just happened to mention it, I’m pretty sure.

And as he's carried on talking - surely there WAS a single-occupancy space, though?!

@Szygy that was the third (24/5 December incident), after which he had to be helped to his car and stayed up drafting a complaint email with his wife.

Do we think when a patient is saying to Dr U 'i feel this way' he says 'well we can't assume this, it could be this, it could be that, it could be something else'. Is anyone else allowed to state anything at all without him undermining it?

NC - photos show locker room is crowded, must get heavy used from several dozen women

NC -not asking for exact number

BU - don't know how to begin to estimate number

NC - 26 lockers. On one shift, crowded with possessions.

BU - you can't assume, some leave stuff on the floor, some people don't take stuff home, it's variable. Number of men/women varies. At least 2/3 staff nurses per area, another 2 for triage, 1 for minors, .... counting ... intermingling shifts ... maybe 10 -13 junior medical staff ... 3 registars, 3/4 consultants, mix of men and women. Varies.

NC - let's agree a number of women regularly use changing room. We can find out number from another witness. We can see that you and the board were willing to sacrifice privacy and dignity of all - None of those women can undress in there confident of a single sex space.

BU - women only doesn't mean 'cis women'

BU - many of my women colleagues consider me a woman. I'm a woman in a space with other women. It's not a cis women only space.
