NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #9

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

BU - makes me upset to think someone considers me dangerous.

NC - what could SP do?

BU - as i said maybe nothing

NC - I suggest you leave SP with no option other than to carry on into CR and change in your presence. ONly thing she could do to stop you from running to supervisor

BU - I didn't run to her, we had a planned meeting. I was upset by SP's action, I wasn' t suggesting she should come back in if she was upset. Not up to me if SP is upset. My upset isn't up to her. If I felt uncomfortable I would leave. Hopefully she dind't mean to upset me. I don't hold her responsible for cuasing me upset

BU - can't answer, not aware of NHS Fife policy

NC - agree likely they'd have found you a single occupancy changing space?

BU - yes probably, they've been supportive generally

I can’t remember the time/date of the incident when he roamed the hospital trying to find people to tell about his 'upset' - can anyone help? It wasn't a pre-arranged meeting with his supervisor where he just happened to mention it, I’m pretty sure.

And as he's carried on talking - surely there WAS a single-occupancy space, though?!

NC - so likely certain you would have been found a single occupancy space, wasn't enought o have somewhere private and safe

BU - as a woman, most appropriate I used the woman's CR. I needed to access teh women's locker room.

As a woman I felt it was most appropriate to use the women's CR. Because that's where the lockers are.
What if given a locker elsewhere?
Unlikely situation but I wouldn't want a locker in middle of a corridor which everyone knows is mine.
