NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #9

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

NC - you did nothing to escalate at the time, but did go to a consultant and reach consensus that SP's conduct was 'unpleasant'

BU - we discussed other issues

NC - you reached consensuse that SP's conduct was 'unpleasan't

BU - as part of discussion we agreed I found experience unpleasant

NC - 'she agreed it was/I found it unpleasant'

BU - it was unpleassant for me

NC - unpleasant for SP to have a doctor discuss with a consultant how unpleasant her conduct has been for that doctor.

BU - doc irrelevant

NC - Two senior people.

BU - seniority not as simple as nurses and doctors, more to do with responsibility, seniority iwthin nurses and within doctors, consultant, charge nurse may have responsibility that a doc doesn't, but senior charge nurse doesn't have prescribing responsibility, not as simple as one person is senior as another, a coll has had an unpleasant experience, gone to supervisor, and recounted experience, not wishing to raise it further but wished to make you aware in case it escalates, we hope it will not escalate further

A woman walked out the room and he's gone off crying about it?

I was given CBT for similar thought processes about my own insecurities, not pandered to.

BU - can't speak to how SP felt, we never discussed

NC - clearly disturbed and upset you that she withdrew

BU - it upset me, yes

NC - what could SP have done to not upset you?

BU - perhpasnothing. My upset may not be avoidable. may be based on prejudice. If a patient sees me and thinks women shouldn't be doctors and goes over my head and speaks to a male doctor, then [sorry having to pause here]
