NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #38

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

If SP is so racist as to treat people differently for racist reasons, she'd be doing that anyway, not just as a result of appearing at a tribunal? But nobody has alleged racism previously apart from one unsubstantiated rumour?

This is fascinating, it appears KS wasn’t aware of the person giving a witness statement.

It also appears KS may have interfered with the witness during the Fife investigation by AG.

Is Sandie was such a well known racist why was nothing done about it? Long before this incident? Long before there was ever any chance of an ET?

KS wanted to use this person.

This person may well have not wanted to get involved because they'd clocked that KS had it in for SP and didn't want to get dragged in - especially if they were also GC.

KS claimed she didn't know anything about KS's views on anything.

Then suddenly she decided she was transphobic and racist all at the same time. Even though she'd work on the same ward for how long and never noticed anything previously.

Na not buying it.

Even if she did, she'll have had to do the annual NHS data handling training - which tells you everything is disclosable.

Anyone else suspecting that the HCA has outed KS ? Can NC call a surprise witness?

Great question now. Asking KS why she was going looking for witnesses. It wasn't her place. She was trying to round up support for Upton.

Also peeved as a mixed race person. We've heard everyone (mainly white) were discussing/agreeing how racist Sandie was and presumably telling any new ethnic minority employees to watch out.

Creates an intimidating workplace environment for ethnic minorities and actually works to condone racism, as seemingly someone who has witnessed/known issue it hasn't tackled and resolved it. Despite that being i.e. in the NMC code of conduct that makes ppl complicit.

Obviously I don't know is Sandie is racist or not, none of us can see inside their head but this isn't an acceptable environment.
