NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #38

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Make a complaint and do an FOI to them to ask them about their policies on this matter. Ask them if their staff self ID and whether they are compliant with single sex spaces following the Supreme Court. They are a public body and accountable to us as taxpayers and licence fee payers.

It didn't matter so much after proceedings had finished for the day yesterday, but I strongly suggest we don't give crapflooders what they want today. They want to bury all the damning and important stuff - don't let them.

it really is shocking and to think they charge a tv license fee for this rubbish.. i think most people have more than one source by now so all the BBC are doing is outing themselves as biased reporters 🤷‍♀️

TT does a fantastic job but having sight of the witnesses giving evidence allows greater weight to pauses, body language etc.

Seeing the flailing of most of the witnesses since the resumption has been stunning. I would love it if they livestreamed these tribunals via youtube.

Also, the email meta data may well be killer evidence. My experience of public sector data integrity is that it is taken seriously and backed up nightly. The IT guy will probably defend what the data shows re the email chain, i.e. "prove it" as KS requested.

Yes, I'm very glad to have been 'in the room' for parts of this one.

We don't describe body language etc unless it's extreme and impacting the evidence. It's very subjective. TBF we are generally so relieved by any pauses so we can catch up that we tend not to notice them until they get really long. Like NC yesterday trying to sort out the email chains.

Thank you @nauticant Doing good work here. Creating and maintaining a place for people to talk is a lifeline - many GC women self censoring in their lives.

I personally try not to feed the trolls because it's minutes of my life I'll never get back.

Does anyone else feel like Kate Searle Day is getting out of hand nowadays? I mean, I know it's really for the kids and that but extending it into two days is a bit much especially with the cost of living at the moment. All the preparations, the excitement and anticipation and now a whole extra day of festivities. It really makes me wonder whether we've forgotten the true meaning of KSD; to celebrate the honesty of doctors throughout the world and remind ourselves to always trust them no matter what.

I wasn't sure if they were going to squeeze the IT guy in before 11.30 or if they anticipated another case management stramash first thing?
