NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #38

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

DU alleged that in one incident SP refused to speak to DU, instead using a nurse as a go between. It was mentioned yesterday and Searle said the nurse didn't want to make a statement or get involved because the case was going to court.

I assume from the reaction that the person NC named is that nurse.

It’s odd. I wonder if there was the main witness and then this, perhaps, is a different witness.

I remember the main witness saying that SP had walked down the corridor with her to find DU and as they walked down the corridor SP had explained the situation to her so she naturally repeated it to DU so SP could get on with other work.

That must have been in the bundle as she wasn’t called?

anyway, I remember that version of events but not how it appeared in ET. Perhaps from someone who had read something about it in the bundle and posted.

Posted this yesterday, the relevant parts of the ''ignoring incident'', posting here again:

DU - I said hi and waved to C. She answered Rhianna, didn't look at me but said no concerns

During Naomi's questioning:

NC - reads - 'on nightshift with SP, ignoring me as usual, Rhianna brought SP, SP answered to R not me', again recorded incident in phone, not as safety for patient issue. Sandie responded to R not you and didn't acknowledge your thanks.

DU - yes when I was close
NC - trivial no?
DU - not when it's a pattern, not even lookign at you again, not unreasonable to think ignoring.
NC - neither SP or R have mentioned this incident in evidence.
JR - SP said doesn't recall this incident
J - will check evidence
NC - nobody else remembers this.
DU - I didn't make it up, it's not unreasonable to say she's being off with me. May well be ignoring me.
NC - refs page. Note of R;s IX interview. Asked if aware of incident and to describe. She remembers conversation occured but not content
NC - contradicts you, she remembers SP and you talking.
DU - appears to contradict

Can the judge probe her in camera to see if this ‘protection’ is justified? Is the oath in a tribunal in Scotland to tell the truth, the whole truth and nothing but the truth or is there a ‘unless it’s something someone else wouldn’t want me to say’ clause?

JR wanted to demonstrate SP was sufficiently performing upset to be understood to have suffered a detriment.

NC establishes that she was part of the group discussing the I/x whilst as SP’s line manager also following instructions to tell Sandy she is not allowed to talk about it.

When asked by NC why she didn’t submit the email with original she can’t remember and on asked about curtailing SP’s ability to talk about I/x claims they were all told not to discuss is which they didn’t ’APART FROM THOSE EMAILS’

This exactly! They knew they weren't supposed to discuss it and knowingly did it anyway. And when they were asked to submit emails they went to lengths to hide it. The way it was handled is appalling and NC is laying it out clearly for all to see.

The allegations that someone else didn't want to take Kate Searle's lead on, because she a miltant left wing basketcase who thinks that a woman not wanting to get changed in front of a man is an act of aggression and hate reportable to the police. Cos she's so 'right on' and so much of an ally.
