NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #38

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I think KS's implication is that we're all so racist that we'll attack Rihanna when she of course confirms how nasty SP was to poor wee Dr Upton.

However I was rather under the impression that the February tribunal sessions had confirmed Rihanna didn't see anything odd in SP's interaction with DU...

Seems to me it's all falling apart. NC started to talk about the witness to the patient care incidents. The one who allegedly mix race and didn't want to be involved.

The one who already stated nothing untoward happened.

DU alleged that in one incident SP refused to speak to DU, instead using a nurse as a go between. It was mentioned yesterday and Searle said the nurse didn't want to make a statement or get involved because the case was going to court.

I assume from the reaction that the person NC named is that nurse.

Protect them because they hid the email and she's covering for them or for some other reason do we think?

My ex use to break down in tears as a way of stopping me from asking him difficult questions or when I pointed out his abusive behaviour towards me.

So LH was just questioned to establish she doesn’t recall any correspondence between the two emails. This corroborated KS but it also means if they do find an email they potentially were both involved in hiding them.

I feel sorry for KS, not that sorry, but like a lot of people she never in a million years thought back in 2023 this would end up at ET.

Fife have a lot to answer for in terms of their duty of care to everyone involved.

KS - I did best I could, next time asked wen't through with IT specialist who helped with terms to search, don't recall that in Jan/Feb, not an IT expert, not been through this before, didn't know personal emails would be made public this way.

To me, it didn't seem sincere.

Although to be fair I would cry too if NC was cross examining me.

I think she is protecting them about the racist allegations.

Who DOESN’T know that work emails can always be disclosed to your employer?

I understand you might not expect them to be revealed in a tribunal, but no-one has an expectation of privacy for their work emails. It's written into staff handbooks FFS!

Re Tandora: I'd just completely ignore them. They are actually engaging with the subject of this thread, and I don't think that disagreeing -however outlandishly - with the consensus is trolling.
But can we please agree to stop responding? There have been several requests from a number of posters to stop, and they have all been ignored.
Eventually Tandora will get bored and go away, I think.

But if KS knew about a witness to patient safety concerns she'd have to speak up herself to make sure concerns where recorded and investigated? Surely she can't NOT report stuff just because the witness might get upset???If she knows she HAS to take action? I think the witness scared of racism is one big red herring.

I'm going to say even if Sandie mainly did look at Rihanna rather than Dr. Upton the obvious reason Sandie would be annoyed is that Dr. Upton, I recall, insisted on talking to Sandie herself.

Cos she's a fuckwit, who has been caught out trying to bully a colleague and to uphold an ideology which is a load of old cobblers and doesn't stand up to the teeniest bit of scrutiny.
