NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #34

1000 replies

nauticant · 21/07/2025 09:18

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Would it be possible for people to turn their attention to this post by@FayeRCfrom a previous thread:

I have a similar court case in England's side which aims to protect single-sex facilities for women. It is in need of support to cover legal fees and can be found by searching for Faye Russell-Caldicott on crowdjustice.com

"I have issued an employment tribunal complaint against NHS England for indirect discrimination on the basis of sex (women), religion (Islam), philosophical belief (gender critical) and disability (PTSD) for having a policy in place which effectively renders the supposed single-sex toilet, changing room and showering facilities as mixed-sex."

There's more information here: https://sex-matters.org/case-briefings/faye-russell-caldicott-v-nhs-england/

IMPORTANT NOTICE. According to PRESIDENTIAL GUIDANCE ON OPEN JUSTICE IN EMPLOYMENT TRIBUNAL PROCEEDINGS IN SCOTLAND dated 14 July 2025:

... members of the public who are observing a hearing ... remotely, and who wish to use live, text based communications during the hearing, must apply to the Tribunal for permission.

www.judiciary.uk/wp-content/uploads/2025/07/Presidential-Guidance-Open-Justice-in-Employment-Tribunal-Proceedings-in-Scotland.pdf

The term "live, text based communications" could include Mumsnet Talk and assuming it does then we need to follow the Presidential Guidance.

The other side of the mountain.

The path is still rocky and theres a risk of sheer drops, exhaustion, injury and attitude sickness.

Enjoy the view though.

Charabanc · 21/07/2025 09:38

Looking forward to learning more Fife-isms today 😆

Lottie Myles should be interesting... Let's see what levels of incompetence NHS Fife can sink to today.

ExitPursuedByABare · 21/07/2025 09:43

Ah, oh no, you've suddenly come down with a rancid case of the squits. It's dreadful. You'll have to stay at home and eat tunnocks all dayyyyy.

@BezMills Oh definitely.

He probably played Red Dead too, hours pass in the blink of an eye.

Although I have played both, I don't assume the real world revolves around me. 🤔

Signalbox · 21/07/2025 09:59

I can't see this starting on time today. So much has happened since Friday.

Justabaker · 21/07/2025 09:59

I suspect there will be closed discussions between the judge and the counsel for each side.

PersonIrresponsible · 21/07/2025 10:02

I have a black screen with the Clerk's name on. And 32 people showing as present. Anyone else got the same or shall I "on again/off again"?

Hoardasurass · 21/07/2025 10:02

Thank fuck I've just caught up on the weekends threads in time for this mornings shitshow.
I wonder what NHS Fife will have to say for themselves (through JR ofcourse) about Fridays ever changing statement
