NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #28

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

IB was dealing 'frequently' with queries about trans issues - at least weekly. We know of fewer than half a dozen trans staff at Fife, but there will no doubt also have been questions about patients.

None of these frequent questions were about changing rooms.

So what were they about? Surely at least some would have been about various types of single sex space or provision (loos, wards, staff performing procedures amd examinations) that cover many of the same issues and rely on the same areas of law as the changing room question.

I’d speculate many of them were about allyship and celebration/validation.

And I can’t write “allyship” without thinking of The Big Ship Sails Down The Ally-ally-o.

Maybe this info is still to come with future witnesses, and maybe it has already been explored in tribunal (I'm late to the party), but I'm curious as to who signed off on SP suspension. HR? On the basis of what procedure/report/interview etc. between the parties?

Also, what role has the CEO or overall manager of Fife NHS got in all this? If none I wonder why. Is everything delegated including ultimate responsibility? If so, why the heck is there a chain of command in the first place.

Look I'm not expecting anyone to do the research for me, I'm just thinking out loud!

Just popping in to agree that DU is not highly trained. He graduated in 2021 from Dundee Medical School, presumably did Foundation years 1 & 2 somewhere then was appointed as a junior clinical fellow - a non-training service post - in a not-very good district general hospital. He's one step up from being straight out of uni and appears to be a very difficult person to work with and have very little idea of consent and medical ethics.

During part 1 someone pointed out that DU seemed to have done a lot of their placements very close to home and this was unusual. Like they’d had special considerations?

She looks like she might have been in university at the start of the pandemic.

She's 27. Entirely likely that she was at Uni at the start of the pandemic.

I can't find the image (I think it's on LinkedIn) but her work history is barmaid, COVID contact tracer and then this job.

She seems to have public health qualifications but no qualifications or experiences in Equality information/advising/law.

I still can’t get my head around the fact that there are admin jobs in the NHS where you can command a 50K salary without comparable, significant, experience. Essentially your first job. It’s madness and wasteful. Who decides and sets these job specs in the first place!?

That would be the nub of the entire tribunal so, since SP has now been exonerated of misconduct allegations. I think!

Tomorrow's witness is the manager of the nursing A+E (I think), so it should make for another very interesting day at the tribunal.

The Vic is a training hospital and I think it's the case that they get students and graduates from three Scottish med faculties. Fife's a small place, so you're never really that far from home if you work there.

Any time that I'm at the Vic I see numerous trainee nurses wearing uniforms giving their designation as students from Dundee. (Can't remember how trainee doctors are identified - maybe via ID badges.) Once they're newly qualified, I think the docs just have the same ID badges as the rest of the regular staff.

I've tried Googling, but can only find specific reference to Lothian NHS Foundation Doctors being placed in Fife.
