NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #7

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

Was it the Edinburgh Rape Crisis one, Harpy? Plus I seem to remember whichever one it was had a clerk who seemed very beleaguered and defensive - obviously DID NOT want to be managing a case with so much public interest.

Have they ever actually started on time? Hardly very professional or a good look for the Courts.

There's been a fair amount of shenanigans from the other side. Friday's strop about only one security guard is the most egregious. And the security guards escort DU out at the end of sessions.

Just speculating: several theories.

  • The disclosure has been insufficient over the weekend, NC on the warpath, JR fighting a rear guard action.
  • DU has realised that their interests may not be aligned with R1 and possibly wants separate counsel
  • DU refusing to appear wants to do the remainder via video, NC on the warpath

@KnottyAuty Not quite if Michael Foran is correct. Even if they had a policy, according to Michael, it would be subject to the law- which states SS changing rooms are a legal requirement at work.

The trouble with NHS "transitioning at work" policies is that they've all been written by activists. Some of them are unbelievably bonkers. Most of them give trans people free rein to chose which showers / changing facilities to use and give zero consideration to the women already using those facilities. It's really quite shocking.

Surely more arguments about insufficient disclosure would be public, given that they have been up to now? Whereas I think a need for new counsel etc might be more privileged... IANAL though.

Also admire Judge Goodman. Allison’s hearing being conducted online gave us all excellent views as the people speaking looked directly at the camera. It was excellent.
