NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #7

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

It really isn't my argument, I'm voicing out of frustration that my husband so nearly gets it but then falls at the last hurdle. I want SSS provided. I'm also not bothered if a woman wants to use the men's, that's for them to debate.

Sorry if you've already said this to him, but surely the obvious answer is that men as a sex class are far more easily able to physically defend themselves against other men than women are.

I wonder if there will be any discussion about the fact that the NHS had a contradictory changing room policy. They provided separate male and female spaces but had a written policy that said users were free to chose which one they went in. So they were both single sex and unisex at the same time.

Has anyone managed to find this formal policy which existed in 2023 which explained how NHS Fife assessed "on a case by case basis" how those who were not born biological females were given permission to use the female CR?

Because if they can't provide that policy then they can't deny SP's claim that they permitted Dr U to harass her (and other staff) by using the CR - which is a breach of EHR

Have I got that right?

which tribunal was it where they only allowed about 40 observers online as they said the system was not able to cope with that many users at once?

i think this tribunal proves that the IT is well able to cope with more users, and the previous issue was due to the burden on the clerks to monitor the IT.

It's to highlight problems in accessing the livestream, audio/video quality, that kind of thing @Swashbuckled but occasionally some people go beyond that. That's not a good idea.

@KnottyAuty Not quite if Michael Foran is correct. Even if they had a policy, according to Michael, it would be subject to the law- which states SS changing rooms are a legal requirement at work.
