NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #7

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

NC questions about permission to use the woman's cr.

Did anyone resolved the same issue?

NC: it was put to the C that you have the board's permission to use the women's CR.

NC: Reading from Upton's statement 'As a trans woman I had iin previous jobs used women's CR and that is what I intend to do'

DU - This was my understanding based upon my previous experience

BU: Not exactly, this was my understanding based on previous experiecne
I'd say she didn't just acquiesce, she considered my qu and agreed that was the best way to proceed

Discussing BU assertion that they have used female changing rooms before and intend to do the same again.

Nuance is that BU outlined an intention as opposed to seeking permission from KS. And that KS acquiesced rather than gave permission explicitly.

BU refutes this and characterises KS as giving permission and guidance to use F spaces

NC: You were well aware, weren't you, that some of your female colleqauges would be unhappy?

BU: I'd disagree. I'm aware that some people are uncomfortable with trans people but I don't think that in my understanding, that doesn't automaticlaly override a transperson's right to use the CR that aligns with their gender identity.

He's just using it as a soap box, not answering the question straight. That's going to go down well.

NC: You note in summary of events: 'I was open about my TG status and expressed my intent to continue using CR while acknowledging you know some women are going to be unhappy'

BU: That's not what I'm saying. Misinformed, biased, bigoted, transphobic views, views about trans people, I'm aware people hold those views, may be opposed to the inclusion of trans people. Was aware I might work with some of those people.
