Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I don’t think this is correct, I’m sure both sides share documents in advance precisely so no trial by ambush occurs. They go through the discovery process to prepare their cases to the best of their ability.

Surely only the barristers. If witnesses can't follow the hearing in the news, how would they be allowed to see the bundles. And surely Searle would have known about the HCA and that her emails had been found if this was the case.

Exactly sex is a protected characteristic. Why would females legally be expected to humour males in single sex facilities?

? is nursing considered a working class profession in the UK? I'm surprised, not my experience of nurses.

This witness has admitted seeing the bundle. Witnesses are not supposed to see the testimony of others. Either she's been following online (told not to) or she's been coached (not allowed).

And she should realise that witnesses talking to each other did compromise her investigation.

Fuck what? I only turned my back a few seconds to put the kettle on, and this happens!

KS was DU's clinical supervisor (ie responsible for overseeing his clinical work but also some responsibility for supporting him with any work-related wellbeing issues) so she would have had one on one meetings with him in this role and he would know her better than the other consultants he worked with.

The thing is, employers by law don’t have to carry out every possible reasonable step. So in your head you might be tallying up all this unfair treatment as a strong case, whereas the tribunal just needs to be satisfied that the employer did the bare minimum to reject it. Therefore I wouldn’t confidently say any ongoing employment tribunal is open and shut. Just because an employer can do something, doesn’t mean they have to.

Bare minimum would be not bullying an employee and providing her with single sex spaces as per her legal right, surely?

It's not a working class professional per se (I know a very very middle class psychiatric nurse) but it's not held as high in status as doctor within the field and the point is that SP's background is working class and Upton's isn't.

It's a working class female nurse against a middle class male doctor.
