NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #40

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

This is madness, if you're not allowed to leave a changing room when someone else is in there in case you upset them then by the end of the day you'd have the entire staff trapped in a changing room.
Or is it possible I have that wrong and there only certain 'women' that you have to stay in the changing room for?
If so, how do they differentiate between the women you must stay in the channing room for and women you don't?

This just conjured up such a hilarious picture for me, like some weird computer game where once in they're just banging against the walls unable to leave. Certainly explains a lot about waiting times and the NHS staffing crisis. Turns out there's plenty of them, they're all just stuck in the changing rooms so as not to offend anyone. Brilliant 🤣

Ms Russell's interjection came after Ms Cunningham asked Ms Glancey why she did not ask Dr Upton for the medic's full statement, despite Dr Upton offering this in an email in April.
Ms Cunningham asked if it was correct there were "two versions" of the statement.
Ms Glancey later takes up Dr Upton's offer of the additional details about patient safety.

It may have already been posted on this thread ut the University of Edinburgh have previously deemed 'avoidance' (I.e. waiting outside a changing room or leaving) as a microaggression in advice given to staff and students.

My God, it's like something from 1984.

If women aren't happy changing in front of men, there's no recourse because the lady mens is entitled. So if women self exclude to avoid the situation, well no that's not on either, that's a micro aggression and women must be punished.

Truly terrifying.

The NHS pension has no simple answers. Assuming she wants to claim without reductions for early payment:

The pension she's earnt since April 2022 can be claimed at 67.

The pension earnt between April 2015 and March 2022 can be taken at 67 or whatever the age is for the rest of the pension below. At 67 it will be worth more, but she won't get it for as long as if she takes the lower value earlier.

The rest of the pension might be 55, 60 or 65. This depends on whether she paid in as a student, whether she was part of the misselling that led a lot of students to withdraw their pension payments at qualification, the exact date she started work, whether she's had any breaks from nursing (or from paying into the pension while working), what choice she made in Choice 1 in 2008 or Choice 2 in 2015, and whether she's employed in a nursing role at the point of retirement.

We are back after a quick break.
Jane Russell KC has interjected to Naomi Cunningham's "repeated" misgendering of Dr Upton.
She says this is confusing for witnesses who refer to Dr Upton by their preferred pronouns.
Ms Russell asks the judge about the fairness of the proceedings of misgendering Dr Upton.
She said it is causing offence to witnesses and said it is confusing for them given they are not used to Dr Upton being referred to in this way.
These concerns should be noted and she urges Ms Cunningham to reflect on the comments.

I thought they’d already had the argument and NC said from the off she would be using pronouns based on sex not GI.
