NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #40

1000 replies

nauticant · 23/07/2025 21:35

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Is AG confirming that the patient safety issues were in fact not the reason/justification for the suspension as is claimed, if the first she’s hearing of them is months down the line?

I think it's the initials of an HR person - Michelle somebody.

Was she the one that was always off sick?

Seems to have been.

I've lost my connection and can't get back in at the moment 😔 Normally they've been very quick at readmitting people

MarieDeGournay · 24/07/2025 10:58

Oh, it's a long, long while from May to December
But the days grow short when you reach September
When the autumn weather turns the leaves to flame
One hasn't got time for the waiting game

I’m being a bit dense - can anyone tell me what MSF stands for?

September!

Was SP back at work (on weekend days) at this point? I thought she returned in April 2024 but I may be misremembering.

Ms Russell continues to push Ms Glancey on her investigation and the earlier drafts. There are some questions over the bundle and dates.

Which complete contradicts Fife's insane statement last which. The one that declared 'it wasn't just about changing rooms, the suspension was due to patient safety incidents'

MarieDeGournay · 24/07/2025 11:02

JR - correspondence with DU 8th Sept, about?
AG - diff of opinion over whether DU washing hands then got changed, it came up in conv with SP, asked DU for version of events

SionnachRuadh · 24/07/2025 11:02

I've actually heard it said seriously - this is in public sector settings following Stonewall law - that if you enter the ladies, see a TW and immediately leave, that could be an act of discrimination. So the only way to be safe is to comply with what the TW wants.

It will take a long time to shift the public sector.

Ms Glancey is asked how she deals with conflicting accounts in her investigation, she says she has used her "own expertise and knowledge" and that it's a "balance of probabilities".

I think the witness will demonstrate that Re: is a header which the system generates when you hit reply. Thus she will prove the later submitted Foot and Mouth email was part of a chain and for all 6 to have not submitted it in initial disclosure demonstrates collusion.

Their credibility will also be destroyed as their dissembling around her question about whether the start of the chain will be demonstrably nonsense and the only reason neither KS or LH admitted it was the first of the chain was because they had agreed in advance to do so.

I wonder who submitted it in the end. I think from one of KS’s answers it wasn’t her (NC questioning around her lack of finding it also suggests not her).

I think dear DU included part of it in his submission to the GMC. With friends like that…

Or a really short time after a massive tribunal payout and mass sackings. We can hope.

JR - you not produced first time round, but first to Adam watson email. Please note, C rep said no need for admin emails
AG - before Feb, I thought it meant letters, emails btwn me and MSF, but not administrative emails, diary commitments, trying to get meetings in

JR trying to 'explain' missing emails?

Fuck me this is the most depressing thing I’ve read today. I work in the public sector and I can see this happening.

Butchyrestingface · 24/07/2025 11:04

Because the world is so mad these days, I won't be convinced SP has this in the bag until I hear the ruling. Sad

It's so ridiculous. All about not making the T person feel uncomfortable- nobody cares if a woman feels uncomfortable.

They're trying to restrict our freedom to leave a room now?

The evidence of Peter Donaldson will be interesting if he talks about this.
