NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #38

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Tribunal Tweets said Upton asked Peggie why she was waiting outside, instead of entering and getting undressed. As Peggie waited outside for Upton to finish and leave.

Yes and he said that any women who had already requested same sex care who was then confronted with him and managed to advocate for themselves would be seen by him as transphobic and aggressive.

We know that he could then feasibly use this as an excuse to have care withheld from these women.

She is saying that she assumed that Fife would illegally hide emails just like she would? Surely that is throwing herself under the bus (and makes no difference to Fife's lost cause case)?

Is there a way we can have @Tandora removed from this thread? This is a freedom of speech issue: he is compromising our freedom of speech by constantly disrupting our right as a group sharing the protected characteristic of GC philosophical beliefs to self-organise and discuss a matter of considerable importance to us.

If he behaved this way in my lecture theatre I would have him removed by security; all my students are welcome to a huge range of options to exercise their own right to FoS and right to protest, however obnoxious their attitude, but when someone disrupts a class by impacting on others’ ability to participate in the discussion by taking up so much of others’s time & energy through derailing legitimate discussion like yesterday he takes away others’ right to FoS. I’m pretty sure I wasn’t the only one who self-excluded yesterday because we find his derailments so very exhausting.

*I am assuming male pronouns because in my experience the people who display the kind of entitlement to elbow their way into other ppl’s discussions to repeatedly impose their unwanted views on others are statistically overwhelmingly likely to be male. I recognise however that class and/or nationality and/or age may be involved here: entitlement and rudeness are not entirely the preserve of men; if this person turned out to be under 25 (i.e. before the brain’s capacity for empathy has fully developed), and/or middle-class and/or American, then they may possibly be female, but statistically I think it unlikely.
