NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #34

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I've had WTTC and now a black screen and list of observers. It was like this on Friday and then suddenly sprang into life with sound and visuals.

If Sandie's team are parking further action on the Statement in order to prioritise cracking on with her case, as I would expect, it shouldn't disrupt things too much.

Given this judge is clearly in favour of open justice I would hope that he'd extend that principle to discussions about Friday's statement but I can see he might well decide in the circs to deal with it in a closed session.

On the TERF picnic topic from the last thread, I can bring a potato salad? I make a good one, if I say so myself. You need a good waxy potato, a mix of (proper) mayonnaise with a dollop of salad cream, and some chopped spring onions.

Sounds good! My recipe is just boiled new potatoes, mayo, mustard and salt.

I forgot about my Celeriac remoulade for the picnic! It's so good that even dubious people are brought round to it.

They've just taken the orphan statement at the bottom off, as Maya F calls it. But have kept in the nonsensical bit about Sex Matters in that paragraph - because that is now the only place in the whole statement that mentions SM, so it just looks weird.

God they're incompetent.

Are they being this utterly perplexingly incompetent on purpose or something?

This is what's so insidious. I really hope its brought out in questioning at some point.

There have been several responses that it’s common for female doctors to use the nurses’ changing facilities.

Uf SP’s legal team consider the matter to be relevant, I trust in their expertise and understanding and that they would mention it.

I'm from Edinburgh and we've always had a bit of pidgin French on the go among pals. You've got me wondering whether everyone in Scotland does it!

I've unconsciously renamed Big Sond: Le Grand Sond.
Wee Sandie: La petite Sondite, which means "little probe" in French. I like it!

There are quite a few French loaners in Scots, not sure if there are more in Fife than elsewhere.

What we do have, in common with other E Coast dialects in Scotland and N England, is a lot of Dutch-sounding words, which could be from old Danish or old Dutch. Either way, it's a linguistic legacy of the cultural links crossing the North Sea.

Example, this sentence 'Ye ken ma dochter' is perfectly understood in both the Netherlands and Fife and other E-Scots areas.
