NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #34

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

By the way I don't know if anyone remembers my little teeny foster puppy back in February that I named Sandy ( after Sandy Peggie). She was only a couple of weeks old, it was touch and go. For some reason MN wouldn't allow us to post pics.
Anyway here she is now.

Big Sond has his normal court baffies on, much to JR's relief.

There's a well-worn Hoggs of Fife carrier bag in the corner, that looks about the right size to have a pair of size 12 arse-kickin bits in it. Big Sond has made sure it's quite clearly visible to both the Barristers. Nothing that happens in his chambers is an accident, he's done wi this pish.

I assume that the next stage will be claims of discrimination on basis of gender reassignment because of enforcement of single sex provision.

I suspect many would be hard to prove. I could imagine a case where Jack comes into work the next day as Jill, pretty frock, long haired wig, plastered on make up and the boss calls him into the office and says, "here's your P45," and that would look like direct discrimination and ought to win.

But what sort of case could Upton mount?

Years ago, when this all kicked off, I genuinely thought it would only take one newspaper's headlines, and the whole country would go, ahh, ugh, and that would be that.

In a way, I'm almost glad it didn't. Because this sort of exposure, the startling self entitlement, lack of empathy, and insane claims really nails it home that as an ideology, it's simply not to be accommodated. Ever.

Even the terminally ideological, relentless be kinders will be thinking there's no fucking way we can ever cave to this without losing every shred of our reputation, and every penny of our money.

They've just taken the orphan statement at the bottom off, as Maya F calls it. But have kept in the nonsensical bit about Sex Matters in that paragraph - because that is now the only place in the whole statement that mentions SM, so it just looks weird.

God they're incompetent.

The man objection seems to be that everyone can now clearly see how one sided and unprofessional the health board's procedures have been, and it is all down to Sex Matters ( for bringing the case in the first instance)
