Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I tried to apply early for a access (end of June) and received this response after a day or so:

At present the Tribunal will not be providing links to observe the hearing in the above case. Information on how to observe the hearing will be made available in due course. The Tribunal asks that you request a link closer to the time of the hearing. The above case hearing will be resumed on 16th July 2025.

I was heartened that it wasn’t a flat out no - made a further request last night so will see what happens..

The details for online access are usually sent out quite close to the hearing date, and as no one has reported getting theirs yet I wouldn’t assume too much about not hearing back.

The indemnity scheme bankrolling this case for Fyfe will surely be demanding prudence on their part. They won't allow them to continue with a lame duck case.

Neither the indemnity scheme nor NHS Fife have control over whether they continue or not. Only Sandie Peggie or the judge can end the case.

Fife can offer a settlement, but cannot force its acceptance.

And if I were Sandie I'd want the court to publicly examine the patient safety allegations - a huge personal and professional detriment to her - not have them paid away quietly. And I certainly wouldn't accept an NDA-linked settlement, or anything that didn't include a full and prominently public apology from Fife, Upton, and KS.

I didn't even get a confirmation of receipt email, and I've checked and triple checked that I mailed the correct address with the correct info... I'm hoping that this is because I had also mailed before they announced the arrangements, and those people were treated differently because we were already on some list...I had the "mail closer to the time" response to my earlier mail. Ah well, whatever. It does seem a bit short-sighted to expect people to be able to attend every session over a 10 day hearing, and not tell them whether they are one of those selected to do so until a day or two before it starts.

I completely agree. It is not how anyone operates surely, keeping all those days free with no way of knowing of you'll get a link or not? How many people does that realistically include?!
