NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #4

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

@KnottyAuty given that he discredited himself re the Isla Bryson thing, the judge is likely to consider his evidence as not credible especially if he is a no show tomorrow.

It deserves to be more widely read. It's a fair point, if Dr Upton passes so convincingly (irrelevant imo) he could get a bunch of waverers on his side by having a recent picture published. It's telling that he's so camera shy.

I certainly avert my eyes in changing rooms, and have been very uncomfortable on the two occasions a woman has been somewhat, shall we say, uninhibited. I don’t want to talk to people I don’t know while changing, particularly if they’re naked. Neither do I want a demonstration of how to apply body lotion to every inch of body.

Is it a bit weird to ask somebody who is so obviously a bloke or woman (or perhaps a bit butch or feminine) about their chromosomes?

It's not as if you can pop to the shop to get a different set?

The BBC said this in relation to the child patient who left before treatment:
The tribunal was told Ms Peggie refused to acknowledge or look at Dr Upton when discussing the patient.

I've just realised that this is how it was reported when SP was speaking to a fellow nurse with Dr U present. He did not mention that she did this when they were in the cubicle and she said he could do the obs. Surely if SP had not looked or looked aggressively he would have kept a note of this. So by his own evidence SP did speak to Dr U (1 out of 2 times in a work setting as opposed to in the changing room) in a way that was unremarkable and not noteworthy

I had no idea that the rhino level thick skin I had to develop in my male dominated profession was totally the wrong approach. I should have taken time off sick and got loads of free therapy... then again my career would have been in the toilet and life would have been rather miserable. So I am glad in retrospect that I was brought up in the 1980s-pick-yerslef-up-and-shut-it-lass style

The BBC also reported this unqualified statement:
This left Dr Upton feeling "saddened" and "unfairly judged", but not wanting to put in a formal complaint to avoid making a fuss.

But Dr U did indeed make a spectacular fuss!? After stating the above early on - but unusually making notes on SP since first meeting - Dr U went on very swiftly to top level fuss to: a) submit an NHS Datix record b) raise a formal complaint for harrassment and a hate incident and c) accuse SP of professional incompetence for possible ignoring in 1 out of 2 work conversations leading Dr U to decide that this had the "potential" for impacting on the care of patients.

In my experience of a professional workplace this is not typical behaviour by Dr U who seems to be right up at the top end of the sensitive scale and very prompt with taking formal action and reporting on colleagues

The day after my dad died at the Vic, I had to go back for his death cert and complained when I saw that a doctor had signed him off as DNR without informing me. (Dad's name was on the whiteboard in the office. I had POA for him, so should have been informed.)

A nurse walked me out of the ward, accompanied me in the lift and all the way to the door, to make sure I didn't kick off in front of other relatives, etc. Ostensibly, she was accompanying a bereaved woman as an act of kindness. Nope.
