NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #4

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

If when SP told Upton he was a man that genuinely was the first time anyone had ever said anything like that to him, I am intrigued as to how he will react to being cross-examined... 😂

I reckon DU is heading for a charge of gross misconduct at the end of this.

He cant carry on in the NHS after this charade. Needs a less stressful job..god help any person on the operating table if he walked into the theatre..

You can't have a witness refusing to be questioned by the opponent's barrister presumably?

Sadly can't watch tomorrow, but I'm glad I got to see this this afternoon. NC is going to have to handle him carefully I think, as he's so good at this delicate little flower act...

I dont actually know which judge rules on anonymity. however if it wasnt this one it still isnt likely to enhance the case. Judges dont generally like other judge's decisions questioned either.

Perhaps JR has given up on this case and is preparing the anonymity argument for the next one.

It's possible that JR filibustered to ensure this could work as if he were already there when NC started, he'd be stuck.

I can't imagine it will do his professional chances a lot of good if he goes off sick. He's already shown that he can't handle a nurse looking at him in a funny way or refusing to wave at him. He's been on Sertraline. He's cried in front of a manager. He's "taken refuge" in a cupboard. Would you want to employ someone like that in a busy hospital where patients and their relatives are frequently aggressive and hostile to staff?

Did you perchance do the auto, woman and a man called Phil remark? If so, I don’t know why you’d be deleted, as this term from the academic work of Ray Blanchard has just be referenced by Maya Forstater in her evidence to the current Employment Tribunal. Probably in the bundle. I think she was discussing the various types of male cross dressers Blanchard discussed.

Again the term ‘crossdressers’ is included under the ‘Trans’ umbrella of the Scottish gov’t. MF also submitted a list of fetishes men can exhibit to illustrate some of the many sexual transgressive behaviours that males can commit. In the bundle, I presume.

Guess the judge will give a day or 2 to "recover" if he does not appear else the the case will fail or be withdrawn. Place your bets here...

And a huge waste of money and time and stress for everyone involved.

From the BBC "Dr Upton and NHS Fife had asked Judge Antoine Tinnion, the employment judge presiding over the case, to hold the tribunal in private to protect the identities of those involved."

Judge now is Employment Judge Alexander Kemp - so different.

Re deletions - didnt' see the deleted comment, but as a general rule, this is a live court case. Scotland has very strict contempt of court rules. Open justice is a new thing, streaming cases is also very new. It's fragile and they could decide not to bother if it causes upset, or if there are lots of complaints, or reports.

(And anyone watching will know this, but it's a criminal offence to record the tribunal and/or share it.)

Personally I am trying to stick to reporting the events as accurately as I'm able.
