NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #45

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed. (Considerable understatement.)

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

LN I wouldnt call him a creep or a weirdo. You might exacerbate the situation by calling him a weirdo so you wld find more information.

Think it's 2 witnesses for the claimant that also objected to Upton in the CR. But were scared to testify before.

Are the messages allowing NC to bring up the discussion of DUs previous behaviour at another hospital?

More than disappointing and not the least bit surprising.

The problem with NHS Fife allowing a tribunal to proceed in hopes that it will out the litigant as a bigot, a transphobe, a racist and a homophobe is that it ALSO necessitates so many other NHS Fife staff showing their arses too.

So now it seems that NHS Fife is absolutely hoaching with:

• racists
• transphobes
• homophobes
• men who want women to get naked in front of them in the women's changing room
• a diversity and equalities lead + several doctors who don't know what a woman is
• a nurse who apparently abandons her patients in the middle of the resuscitation area and everyone else thinks 'no biggie'
• no consultation processes for introducing men into the women's facilities
• breach of the single sex facilities law
• department heads who have no idea what due process is
• department heads who breach confidentiality
• a consultant and line manager who cries on the stand like a baby when her 'kindness' is questioned
• inadequate recruitment processes (see Isla Bumpa)
• overpaid pronoun pushers (see Isla Bumpa again)
• nurses who breach confidentiality in FB group chats
• staff who are okay with working alongside racists/transphobes/homophobes and going on holiday with them
• management who don't GAF about any of the above with the exception of men who don't like being called men or told they're not welcome in the women's changing rooms.

NHS Fife are certainly done their bit for taking the heat off NHS Tayside after all their troubles a few years back.

DU caused chaos for dementia sufferers for the crime of misegendering him.

Dear god, the things nurses have to deal with.
