NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #42

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

All the mystery around 'weird incidents' sounds very contrived when the obvious explanation is that she simply doesn't want to share a changing room with a man.

He can consider that transphobic and disrespectful, but it doesn't make the explanation less obvious.

Unless JB puts in a strong and convincing performance, I think what NC will take from this is that NHSF clearly felt this was an important matter, but didn't deal with it in a proper forensic way, ie spent money on it, and, as was typical, felt that Upton should be given considerable latitude because they didn't want to challenge him properly.

This would imply calling PD is an act of desperation by JR because she knows that JB testimony is damning. In the evidence-in-chief it was JR who first broached questions not of process but of opinion was it not? She has stretched it and so it seems reasonable given that she did that then the panel would follow. But it is clear it is not fact just his opinion as to whether the info as been messed with by DU so that's probably why J let it go?

Have read DrU's notes now - a lot of it 'she didn't smile back at me' kind of stuff, really silly.
His version of 'the incident in the CR' is interesting as it suggests a long exchange, not just SP snapping at him. She explained her reasons and he says he acknowledged that his presence was making her - and possibly other - uncomfortable and intimidated. But tough, I've every right to be here.

It sounds unpleasant for DrU to hear, but not aggressive.

When DU gave evidence at the ET in Feb - a lot of DU evidence of SP's behaviour was like this .... she didn't smile at me/she didn't compliment my hair sort of stuff

In some of the the exchanges DU was aggressive - ie the one with Rihanna. Rihanna asked SP about the patient and SP replied to Rihanna. DU was outraged not to be personally acknowledged and started waving in SP's face.

A lot of these incidents seem to stem from DU wanting to be acknowledged and embraced as "one of the girls" rather than briskly as a temp colleague - he demanded what he thought was "girly behaviour" from the women at work such as smiles, little waves and compliments on clothes. DU needed everyone to embrace the trans-id

I wonder if Mr Borthwick (silent th?) is SP's witness and therefore JR will be doing the cross exam. Bring it on. Judging from this morning's performance she is not comfortable with techy stuff.

I don’t read them as notes, more like an essay. An essay where someone has had time to consider exactly what should be included. In detail. Whilst being distraught and tearful. Apparently.

It's written like a bad AIBU post. It just needs a convoluted backstory involving "There's this person, let's call her Annie" and a "So now we fast forward to today"...

And who writes things like 'Sad times' other than a completely self-absorbed child?

I've written notes on my phone about incidents as they've happened but they've just been a list of very quick notes with brief phrases and words to act as an aide memoire. That's a written up narrative with The Fragrant Dr as the tragic main character.

Call back to previous thread. I'm sorry but I don't like the name 'Beth'. I think it's the 'th' on the end. It seems unfinished. Your tongue is just left waving in your mouth. I'd probably call him 'Beff', possibly 'Bee'.

It is fairly normal for certain types of professionals to keep comprehensive diaries. Politicians are always going on about their diaries full of inanity and appointments and then more detail for unusual incidents. I think if you have a job that's flying by the seat of your pants it's a good practice to have. Any doctors here can say if this is something you are taught to do?

Most A&E doctors I know don't have time to go to the loo let alone write notes on who smiled at them.

Unless you are already looking to build a case - why would smiling and waving even matter in a chaotic A&E

My takeaway from DU's phone notes is that he sounds absolutely INSUFFERABLE.

Those aren't a few quick notes made at the time, are they? That's a whole self-pitying essay written up over time, with additions. It reads like heavily revised and edited text.
