NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #38

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

  1. They deliberately tried to hide the evidence of their collusion by removing this particular email from the chain supplied in the initial disclosure of documents.

Indeed. And it makes me wonder if that email chain had been fully disclosed earlier, whether the participants in that chat might have been named as respondents.

Yes but Upton was an adult married man at the time of his decision, so either he has some sort of emotional development delay and/or he has always been their Golden Boy.

I mean I can sort of understand supporting your adult child through thick and thin, but this is odd.

I'm sure NC will have considered that option, if she doesn't know 100% it's been separated.

but it's a testament to exactly how bloody untrustworthy she thinks they all are, that she would even consider it possible

It seems at least possible that the kind of people who would collude and withold evidence from a tribunal, may also have taken a sneak peek at what has gone on in the tribunal before they give evidence.

If that is true (though prob not because doctors are trustworthy!) then I hope the possibility of being exposed has kept them up every night since February.

I read somewhere, years ago, that statistically, successful women are over represented as mothers of trans children.

The theory being that as their own status wanes they find fresh kudos through a transitioning child.

It's pretty sinister that the "forgotten/lost" e-mail chain included witnesses and those supposed to be investigating the incident and they were openly discussing the case surreptitiously.

But worse IMHO that they copied in DU into these discussions and he was also asking for comments during this period of formulating and editing his own statement. Especially given Fife's extreme measures to isolate and muzzle SP

@Totallygripped Junior doctor rotations are normally 3 or 4 months, sometimes 6 months. They can also spend a short time doing tasters of other specialties, although I thought these were a couple of weeks, not Upton's 4 week secondment in anaesthetics. So I'm actually confused about why he was returning to a&e after anaesthetics and not going off elsewhere.

It'll be because he's a Junior Clinical Fellow which is a very junior service provision post not a training post. There will be a plan of what specialities the person is in for the job description (and to say which dept pays for them) and they need to make the job reasonably attractive to get someone. ED is anaesthetics is a logical combo, durations in each dept will be on service need & financial grounds.
Why Dr U is still employed when a Clinical Fellow post would usually be a fixed term contract is a mystery to me.
Google the job title for examples. There's a haematology one out in Fife just now! On NHS Scotland Jobs website

I took it as meaning that SP was professional and did not discuss things like that in the workplace -i.e. did not 'bring her whole self to work', just the efficient and professional parts of her selfSmile

I believe Dr Upton's Mum is a chaplain and his step-father a bishop. His father's family are academics. A lot of local connections.

I’m sure there was recent chat of Mum doing a PhD and Dad as curator/ librarian. Not sure it’s accurate or relevant - needless to say well resourced middle class family.

But what she does care about is her own dignity and safety in a tiny changing room.

My personal opinion is they should all be done for it.. they discussed an ongoing investigation cane to conclusions in favour of Dr U and then proceeded to hide these emails from the court.. there must be one or two things there they can be got on.. but they will no doubt get away with it and be offered a pay rise.. usually the way these things work..

For a 'quick format' (or corruption) on any kind of disk, some free or cheap "undelete" software can recover most or all of the files, depending on what has happened after the format.

A curious thing about magnetic media is that if you go deep into the physical ferromagnetic layer, it's possible to determine both what is there now, and what was there before (as in you can in some cases see previous data that has actually been overwritten). A binary 1-was-0 is distinguishable from a 1-was-1, if you look closely enough.

This is not something you can do with a bit of freeware on your laptop, you need a clean room to disassemble the HD and extremely expensive equipment to read the platters and analyse the images. This is MI6 or Serious Organised Crime level stuff.

Modern file scrubbing software takes that into account and writes over the binary bits multiple times, hopefully thwarting any reliable analysis of the historic state of the bit.

Indeed. SSDs are somewhat different. When you overwrite the data on an SSD, you aren't actually overwriting it at all because of the clever ways SSDs and similar work to hide the limitations of the hardware. However, getting well off topic here!
