NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #31

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

So this witness has just confirmed Sandie was suspended just for daring to say to a a bloke he shouldn't be in the ladies, and multiple nurses felt the same way. (So for expressing her GC beliefs, & seeking to protect her bodily privacy protected in the UK Equality Act and international human rights from a man) . There were no concerns about anything else- not rudeness, not leaving a patient etc.

that allegation is what we see, that she had approached a trans id man in the CR and shouldnt' be there because he's a woman. Nothing there about her manner LC -no just the doctor was feeling after.

My family members are various emergency services. Two of them struggle with the smell of a certain food ( not curry) as it's a reminder of certain unpleasant events they attended.

So I don't cook it when I have them over. That doesn't make them evil and bigots.

Don't forget smells are an issue for anyone who has a sensory issue. Eg - it could be a problem to not take into account someone who is autistic and has a particular aversion to particularly strong smells IF politely requesting they switch to something less anti-social and then the person ignores this and persist and makes a point of taking smelly food around someone.

You would be looking at potential discrimination and harassment.

Alternatively you could consider the law to say you must identify as asexually straight, asexually bisexual, or asexually homosexual.

I agree it would be better if the Equality Act specifically recognised asexuality, but I believe that, were it to arise, the courts would take the view that a lack of attraction towards any of the three groups mentioned is a sexual orientation.

The only reason Sandie stayed at a Trump hotel ( which is why all this Trump support crap is happening) is because Fife nhs had a holiday deal for nhs staff to stay at the hotel.

I am no fan of Trump but if we are going to demonise everyone who's ever used one of his facilities, there's going to be a lot of travellers and golfers we will need to ostracise.

Ive asked this before (not of you) and never had an answer. Direct discrimination is defined as “because of” a PC, not because of a PC held by the person complaining of discrimination. In other words B doesn’t have to specifically have that PC. In contradistinction, indirect discrimination can only be unlawful “when because of a PC held by B”.

That usually comes in to play in discrimination by perception.

But I also infer from this that you cannot lawfully discriminate against someone who doesn’t hold the PC of GR, which is the prohibition against positive discrimination (unless a specific exemption applies). Because that is treating the non-GR person to a detriment because of a PC.

Is that fair?

This isn't linked to this particular case, but it's come up in another issue. I discussed with someone today and I wondered if some news outlets are actually using it as a tactic.

Which clearly it shouldn't be!

He had just read online that SP was racist, and when I asked for evidence he said she had stayed in a Trump hotel. I pointed out that NHS staff get a discount in Trump hotels so she is unlikely to be the only one - does that mean everyone in the NHS is racist?

There are stenographers this time, witnesses wont be able to deny what they said. TT are not stenographers, they are unpaid volunteers who do a very good job.

When the attempt to deny them access came out I emailed pointed out they were a lot more accurate than the mainstream press.

That is fair and I think that is how the courts would approach it.
