Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

The statement has the air, to me at least (and I used to be involved in this sort of thing) of having been drafted and then repeatedly amended, probably by very senior people keen to get their own point in. E.g. there are several grammatical errors, including one in the first sentence ("NHS Fife is setting out its position on a number of matters related to the ongoing employment tribunal and provide clarity around some of the misinformation circulating around the tribunal case that NHS Fife is defending."). That suggests to me that no one person has been in control of the changes, nor made responsible for proofreading and sense checking, which, again, suggests it's been very hastily put together.

I hope someone, somewhere, has a "Track all changes" version of it, because that would be absolutely fascinating - the metadata is very rich in docs like that (which is why you always, ALWAYS pdf them before you send them to anyone).

The earliest archive version has a time-stamp of 14.31 so the statement would have been up several hour before close of play.

This is insane. I was out for part of the day and have spent hours trying to catch up, but I don't think it's possible. I suspect battling colleagues are busy adding and removing each others comments in the document and attempting to publish their own one. And anyone with any sense (if there is anyone with sense still involved) is probably trying to leave the country.

If it's in Word, you have to switch it on deliberately, but if you're using e.g. Google Docs, it's in there from the start so you need to cleanse the doc before sending it to anyone who doesn't need to know about the fighting that's gone on!
