NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #31

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

That's right. Those who are able to regulate their emotions (like all adults should) deserve no sympathy, and are probably lying too.

Can the repetition of this hearsay smear during the hearing be used by NC in support of the victimisation claim? And/or could it go to damages if Sandie is successful on this claim?

At the start of.LC testimony JR asked LC about what strong views Peggie held. LC went on to say views about race and religion. Stated that she had complained about certain food smells in the staff kitchen and had made a racist comment to a doctor. But that this was all heresay and she's never witnessed anything. So why fucking mention it when there is no proof. To get a chance to paint Sandie as a racist bigot?

Completely unacceptable. You can't spread gossip in a tribunal as though it's fact.

Disgraceful, but of a piece with part 1 where they tried to brand SP as racist. Even if she is (and I have seen nothing to suggest she is), it is irrelevant.

Did any of the other observers think that JR wasn't pleased to discover that the convo was on speakerphone and that a 2nd person could confirm that SP was matter of fact - ie she was unaware she had been labelled a bigot so wasn't showing sufficient contrition. Interesting that this didn't raise questions in the minds of these 2 staffers about whether the version of events from DU was entirely reliable?

btw my husband, who had heard snippets from me, decided to read the bbc account of yesterday's proceedings. He noted the bias in the headline but was full of praise for Naomi. I told him that he'd seen nothing yet.

We all have the protected characteristic of sexual orientation. My orientation is heterosexual. That is protected. Whilst I have never needed this protection, I am nonetheless protected from being discriminated against for being heterosexual.

I see no evidence the Sandie is racist. But even if she was, what’s that got to do with not wanting a biological man in the changing rooms!

@prh47bridge Protected characteristic only matter if you are considering discrimination. Upton claims to be lesbian. The witness only mentioned it because she was accepting his description of himself as being a lesbian.
