NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #31

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

NC dramatically called for a pause to consider ...
JR did her best to say something sensible - quite an achievement in the circs!
Judge said judgy things about thinking about it and they'll deal with it on Monday.

So there was a small bit on TT, just before the 'that's all folks!', but it will be Monday before it is discussed in detail.

It's a bit of a drive by shooting from our perspective. We're thinking about whether we need to respond, but I'm not thinking it's necessary. Our friends and followers don't need us to do it - our critics and haters will never be appeased.

She is a true believer who has been involved in several of these cases. TRAs and their allies don't seem to care that she always loses.

And yet for unfathomable reasons the Environment Agency have chosen her to represent them in the Employment Tribunal against them and Andreas Mueller, where the claimant is looking to have the SEEN network shut down. Considering she said the FWS ruling was 'abstract' and only relevant to Scottish boards I am not hopeful.

I think responding simply would show how much integrity and indeed the very simplicity of what you’re doing. People have been trying to hide this abuse and sidelining by organisations of their employees. You and the team are dedicated in bringing light and clarity into the situation by airing the proceedings. Have a think - but may be worth something for the record. 🙌

Leaving on one of the busiest shifts of the year because someone used some hurty words. Then made up a lie to get that person sacked.

I am utterly at a loss to understand Fife’s behaviour. A statement that long and detailed would have taken a fair bit of time to draft and proof read. I cannot believe that some reasonably senior people were not required to authorise its publication. This is not the work of a misguided intern or junior admin person.
In one fell swoop they achieved:

  1. Giving SP’s lawyers a massive free shot at an open goal
  2. Annoyed the Tribunal
  3. Undermined their own lawyer’s ability to undo some of the more damaging witness evidence
  4. Triggered a fresh investigation by the rather fed up Scottish ICO
  5. Got BBC headlines changed from positive spin to negative
  6. Brought the case to the notice of even more people because this is the sort of thing the press loves

Its a textbook example of what not to do.

Isla is starting to look lfar from the least competent employee NHS Fife has on their payroll.

Fife's own witnesses this week have shown the shambles that exists within the organisation with incompetent staff and no proper procedures.

I think Fife went into this with a fair amount of hubris - they expected SP to just accept her scolding and suspension. So they made the - IMHO - very unwise decision to fund a joint defence with DU without even considering that NHS Fife and DU might have divergent interests on some points and they really needed to distance themselves on come points where it is clear that SP and DU were not treated equally in the investigation.

They didn't expect SP to come out fighting and to be equally well funded. They thought they'd have the upper hand and could obfuscate, hide evidence etc and it would never come to light.

So SP hiring NC has really pssed them off. So today it seems like they actually got pssed and decided to lash out.

Who the hell with an ounce of brain would want to go work for this NHS Trust now? The tribunal seems to point to an incredible incompetence at best (no due process, no systemic and careful review of evidence) but vindictive and incapable of acknowledging mistakes at worst. No wonder there are so many medical scandals.

I have a vision of anyone who have ever been on the board at NHS Fife frantically rewriting their CV to remove that fact.

What can I put instead? I lost these years to drugs, alcohol and prostitution? Yep that way less embarrassing than I was on the board at Fife and probably makes me more employable too.
