NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #31

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I assume NHS Fife thought their statement would be attracting attention shortly after the end of today's session and they'd be providing a lot of "interesting" fodder for the media to play with over the weekend. A sort of spoiler against coverage of the hearing itself, but getting ahead of themselves.

Or maybe Kate Searle sent it to let everyone know that the Comms team condemns Sandie Peggie too.

She agrees he is male but as he identifies as a woman that’s all it takes for her to believe he is a woman. They would have you believe that woman is about gender and female is biology

TBF to NHS Fife, the Judge probably did want to finish at 3pm. If this is a ploy to prevent TT from live Tweeting, I will be very disappointed.

Interesting that the complaint about the accuracy of TT came from a concerned member of the public. I suppose that's why Sandie's team are paying for a stenographer.

Whoever has spent the last few hours drafting and circulating that obviously hasn't spent any time following the tribunal today. NHS Fife's own witnesses and the paper trail have all indicated that Sandie's alleged conduct on the ward and the impact on patient care wasn't anywhere on their radar.

I think NHS Fife planned to release it at 4pm, when the tribunal stops sitting, but didn’t actually check if it had finished for the day.

Also they may say they can't stop it because RH get are defending, but plenty of other organisations have stopped legal action by settling.

They have nothing to lose because they are only liable for £25k of fees. Insurance will cover the rest. But, having worked with HR lawyers covered by insurance, the insurers have to agree they have followed all legal advice given to them, and that the case is winnable.

I'd love to see the insurance company force them to settle. And I'd love to see insurance companies stop underwriting these cases and refuse to take them.

So on the one hand we have NHS Fife who have been promoting all the trans stuff internally to the point that they have staff who have sent emails condemning the actions of a staff member etc and directing everyone to say 'we fully suppport Upton' WHILST an internal investigation is on going.

Keeping in mind Wednesday's ruling about impartiality in the police and the need to not be biased in order to maintain public trust and there being all sorts of other related issues.

So when Sex Matters decides to bring a case - keeping in mind that they are NOT tied by any rules over impartiality - and exist to uphold the rights of women who have been denied their rights by public and private organisations like (checks notes) NHS Fife, this is somehow NOT ok.

Meanwhile, having had members of staff dragged through the mud and other members of staff are being held accountable for their (checks notes) lack of report keeping, adhereing to a policy they hadn't written, wasting public finances and having a complete lack of awareness of what the actual law is in multiple areas, there can be no UTTER OUTRAGE at the COMPLETE SHITSHOW that is NHS Fife?

Because that wouldn't be kind.

Oh Do Fuck Off NHS Fife. It just looks like one last desperate attempt to smear anyone who doesn't agree with doctrine. It doesn't look good and it doesn't look clever.

And it definitely looks like its trying to influence matters. Despite saying that NHS Fife couldn't.

They know heads are going to have to roll don't they? They can FEEL the public anger from what they are reading and they do not like it.
