NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #31

nauticant · 18/07/2025 12:49

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Has anyone seen any threats anywhere on social media relating to this since the tribunal restarted? Don't link, obviously, but if you have, say so.

Nope. A lot of 'what a useless bunch of bastards' but no threats.

Chariothorses · 18/07/2025 16:09

@Merrymouse "While the claimant raised concerns about a trans woman’s use of a locker room, this was not the reason that NHS Fife’s internal investigation was initiated. As made clear during tribunal proceedings, the disciplinary process was initiated due to concerns raised about interactions with a colleague and patient care."
🤔
Isn't this in question and currently being established by the tribunal?

Yes exactly.

BezMills · 18/07/2025 16:09

As made clear during tribunal proceedings, the disciplinary process was initiated due to concerns raised about interactions with a colleague and patient care.

Far from made clear, and I think they know that we know that they know that NC is going to shoot the utter bejezus out of their version of events.

we've got a few days of rootin tootin foot shooting cross examination yet to come.

Molocates?

batters

As in, beats up - not dips in batter and deep-fries. Although that's also a Scottish favourite.

I hope Police Scotland deal assertively with any threats or acts of physical or sexual violence, whatever their origin and whoever the intended target is.

NebulousSupportPostcard · 18/07/2025 16:11

Archived version of Fife's vvv recently dropped press statement. (Someone else archived it 24 mins before I thought to do so all credit to them!)

Do we think this is an attempt to have TT access revoked?

Cookiepuss · 18/07/2025 16:11

Still catching up! But this doesn't make sense but then none of it does!

NC - Dr Upton is a 'transwoman' an adult male who wants to be treated as a woman, are we agreed?
LC - yes

JR you were asked if SP should be asked to change in front of a man. Do you think Dr U is a man?
LC - no I don't.

So LC agrees Dr U is an adult male but then says he is not! FFS can these people not hear themselves.

BezMills · 18/07/2025 16:11

Fifer : aye the best kind of weapon is thon that ye can eat after wards. Ye could say first ye dae the batter then ye eat the batter. Nae evidence, nae crime.

ThatCyanCat · 18/07/2025 16:11

Is it even legal to make a statement like that while proceedings are ongoing?

alsoFanOfNaomi · 18/07/2025 16:11

Wonder if JR was consulted on the issuing of that statement, or knew it was going to happen? And if not, how she'll feel about it?

Yes, or reduced to posting end of day overviews, that's happened before.

nauticant · 18/07/2025 16:12

I assume NHS Fife thought their statement would be attracting attention shortly after the end of today's session and they'd be providing a lot of "interesting" fodder for the media to play with over the weekend. A sort of spoiler against coverage of the hearing itself, but getting ahead of themselves.

Never mind size 13 ballet pumps, if you've got feet like colanders where the hell do you get your shoes?

ChazsBrilliantAttitude · 18/07/2025 16:13

I can’t understand Fife’s logic. Scot’s law is very strict on contempt of court usually - not sure if it applies to ET in the same way.

GCITC · 18/07/2025 16:13

I wonder what is going through Jane Russell's head this very moment.

NHS Fife can’t even manage to configure CloudFlare correctly.
