NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #31

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I'm paraphrasing because I can't get back to screenshot it but NHS Fife are basically saying that their action against SP was because of her unprofessional behaviour on the ward, not because of the changing room incident. Oh dear.

Haven’t they just cleared her of the ward nonsense? Am confused.

The other reflection I have from today is that I'm so glad that the question around Dr Upton's fitness to practice, if he didn't report a serious safety issue of a nurse walking out on a patient, was also finally raised.

I have to say dropping a statement like that at 4pm on a Friday when the tribunal is going on is very nhs fife. They’re going to run out of their own limbs to shoot off soon!!!

Honestly, if people are suffering delusions or hallucinations or something like that, what's it going to do to them to be told he's a woman and they can't say otherwise?

Is that not a patient care issue? Along with his assertion that he'd present himself to a woman who requested a female doctor?

But hasn't it already been established that concerns about patient care (Sandie walking out of cubicles etc) weren't even made until months after her suspension. The suspension was solely due to the manner in which Sandie challenged Upton in the changing room?

My final reflection is that clearly NHS Fife meant to post that press statement after the Tribunal had finished for today. Their incompetence across every facet of the organisation continues to astound me.

I can well imagine that the female witnesses in this have received threats, somehow it seems to be the norm these days. Fuck knows why, but I got comments like that just for commenting on a FB post one day. And I'm not in the media spotlight.

I cannot understand why Fife would put out a statement like that in the middle of the tribunal hearings. Unless this is a "just jump on the landmine and get it over with" moment?

NHS Fife focusing on Sex Matters as the eminence grise behind all this is in keeping with a number of attempts to portray SM as a shadowy, right-wing-funded anti-trans body - there are a couple of threads on here about it. The Evening Standard even joined in the 'Who Are SM?' non-investigative-journalism carry-on.

If I was looking for fingerprints on the NHS Fife statement, I'd be looking at who is currently attempting to smear Sex Matters..
