NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #31

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

@MyAmpleSheep TT dont claim to report everything. In the first hearing they also left out Upton saying he was a biological woman. I really really doubt that was an "inaccuracy" Fife's lawyers complained about.

One thing that's just hit me forcibly: the reason not one of these people asked SP why she objected to BU being in the changing room is that they all knew perfectly well why she objected. If any one of them had genuinely seem him as a woman, they might have needed it explained. They didn't.

LC making out that this 6ft plus man passed as a female unless you stopped and had a conversation. So it was only his voice that gave him away. He completely passed as female. To nurses? I'm sure his height would have drawn attention first and then it would have been immediately obvious this person was not female.

Maybe LC needs to take those glasses off her head and put them on her face.

When Upton gave evidence in February I could spot he was a man in the time it took him to take 10 steps to sit down the witness box. It was a rear view and he hadn't said a word.

Absolutely - you know the trap is being set when NC asks you to agree to something which appears to be entirely acceptable.... those 2 paragraphs are a fair summary of events aren't they?

sensing the danger of agreeing to something so patently obvious the witness went into extreme hesitation and had to ask for the question to be repeated.... she sensed there might be a problem but couldn't fathom what it was...

Through the back of her head I imagined I was watching cogs whirring as the narrative shifted to a place she wasn't expecting - she seemed irritated that Sandie had put on a brave face and then cried at her parents' house after being put on special leave...

Not wanting to be too graphic, but changing into scrubs in a hospital toilet is completely inappropriate.

Especially in the middle of winter when there is i.e. norovirus undoubtedly spreading and that could be fatal to an ill patient.

NHS Fife need to pop in a load of single cubicles, may be by the carpark. Not that expensive.
