NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #28

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Why would the legality of allowing TW into female changing areas depend on how many religious women who would take offence are employed?

Suppose there were none, and a policy allowing DU to use the female facilities was formally implemented. Than a cohort of religiously observant women is employed - does the policy get reconsidered and cancelled? And DU goes back to the men's?

That makes no sense.

So she's admitting there's no impact assessment. She has no record of any EA criteria that could be directly impacted. She thinks women with religious beliefs who can't share with male people are the minority (over the 1-5, but probably 2 trans people).

She doesn't seem to be aware of anything - which leads to a direct question of how in the world she was recruited?

The news item was about the internal disciplinary action against Sandie Peggie which cleared her of gross misconduct allegations. That result was made public late yesterday. Today is the continuation of the employment tribunal first started in February.

In any kind of management role you should have good general knowledge of issues which may affect your line of work. This includes an awareness of the news etc. I've literally been on management courses telling me this.

Forstater is an area which has been massively publicised. And she doesn't seem to know if it's existence never mind it's relevance.
