NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #27

1000 replies

nauticant · 13/07/2025 08:26

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It will resume on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions wereFri provided here:

Gads you try to do a favour... I'm literally cut and pasting TT

I'm not ungrateful, honest, just trying to think like a jobsworth controlling remote accessSmile

What other health boards were doing - sheep follow sheep.

Apart from anything else, the waste of money having each board doing duplicate jobs for things that surely could be centralised, done once, implemented across all boards. Same with things like health and safety policy, or recruitment, and yes, DEI, how much localised tweaking is really needed to merit the same thing being done separately by each board. If, indeed, this is the case.

I think we're wa-a-a-a-ay past the point of trying to keep down the total number of pages we end up filling.

I'm glad you have now accepted your fate. 😜

Unbelievable. I write policies in my job - I absolutely don't crib from other Boards, I write my own and I make absolutely sure I'm following the law. The problem here of course is that the actual law didn't suit them and others writing these policies.

I'm currently cutting and pasting from NHS documents, to prove a particular point on the thing I'm doing, that have obviously been produced by a person cribbing off other trusts. They are gobbledygook with sections missing and bits make no sense

@BettyBooper please stop posting your observations of the tribunal. It's not permitted

She's not, she cut and pasting Tribunal Tweets - perfectly fine.

Sortumn · 16/07/2025 11:42

PinkDD · 16/07/2025 11:41

WTF?!

IB - that was consistent with my understanding of the topic at the time, however it seems a bit harsh, language does not acknowledge GC beliefs that they need to be taken into consideration

fuck me, she DOES (now) understand what the issue is.
Desperately windmilling her arms in an attempt to stay on the kerb and not go under the number 94 bus

(disclaimer so nobody has connipations: c/p from Tribunal Tweets)

Not just gc beliefs but the privacy and dignity of women who have to change clothes, deal with periods etc... She's only half way there.

I’m starting to wonder whether we have an intentional disruptor on this thread.

I know it’s annoying but can we all have some patience please. There will be TRAs here looking for anything they can report to the Tribunal in order to gave the public access removed.

we have posters helpfully copying TT and other posters helpfully trying to ensure we don’t lose public access. Both are undoubtedly needed as we also have drop in posters who will not have RTFT and won’t know about the posting restrictions.

What the fuck is "facilitated reflective practice discussion"

Is it wank work speak for having a chat?

Edited

I'm guessing that they want to make her undertake a reflection about how she could have handled the confrontation better, ready for the next time the Health Board acts illegally as her employer?

Once for Scotland policies developed on a number of topics in NHSS. Sadly not this one. Yet.

am eagerly awaiting info from IB if these meetings of the EDI leads included such diversities as disability, age and religion or just the rainbow ones.

I have seen many a NHS manager create such documents 😬

Shortpoet · 16/07/2025 11:46

I hope I am never called to a tribunal, but if I am, especially if there is a gap in proceedings giving me even more time, I’d hope I’d be more prepared as to who I asked for advice and which documents I used to prepare reports.

Could have been other EA topics that’s weren’t trans that the EDI group discussed. But was it? Did anyone apply and critical thinking or try to balance rights? I’m guessing that might endanger your £50k job though, so probably not.

Cailleach1 · 16/07/2025 11:48

Following on TT. Why mention someone with a GRC? We know it didn’t change the law then or now as to male access to female single sex spaces. Even at that, I don’t think he had a GRC anyway.

Big bucks for googling practices in other places with no assurance as to their legality. No legal qualifications. Conversations with advice not recorded.

PinkDD · 16/07/2025 11:49

bloody hell - assuming it's about 5 or 6 EDI leads discussing issues at these meetings, all on about 50k - for more than one but maybe less than 5 if i have understood the comment correctly.

Staggering.

I used to work in the NHS, and would read all the badly written or senseless documents with a sense of annoyance as well as resignation. People don't have a) time or b) the necessary critical/ language/ thinking skills needed to write these things, and even though errors can be pointed out, nothing changes in the churning out preparation of said documents except that they grow ever longer and more muddled.

from TT
IB could be literally any EA topic, trans was a hot topic

Looking at other health boards policies is the wilfully blind leading the blind.
